Thus, the won trials constitute 72% of the cases completed by the Foundation in 2009.
In total, during the reporting period, the Foundation rendered free legal assistance to 5474 (five thousand four hundred and seventy four) families of dead servicemen.
Trials of the Mother's Right Foundation in 2009:
1) On January 12, the Presidium of the Perm Region Court considered the extraordinary appeal filed by the Mother's Right Foundation on behalf of Valentina Petrovna Vasilieva, mother of a dead soldier. Her son, Maxim Petrov (b. 1980), was called up to military service on December 13, 1998, and served in the Railway Forces, Stavropol Region. He died in military service on December 24, 1998, i.e. two weeks after the beginning of his service. Before March 1, 2007, his mother had been enjoying the measures of social support authorized for parents of dead servicemen. On March 1, 2007, she was denied these measures under a far-fetched pretext. On February 15, 2008, the Mother's Right Foundation represented the mother's rights in the Bereznikov Town Court but the Bereznikov Social Development Department, Perm Region, filed a cassation appeal against the Court's decision, and on April 24, 2008, it was cancelled by the panel of judges of the Perm Region Court. The Mother's Right Foundation filed an extraordinary appeal. The interests of the mother of the deceased were represented by the Mother's Right Foundation lawyer, Anna Mukaseyeva. The trial was won: the decision of 15.02.08 issued by the Bereznikov Town Court was left in force; the decision of 24.04.08 issued by the cassation court was cancelled.
2) On January 12, the Pushkin Town Court, Moscow Region, considered the lawsuit filed by the Mother's Right Foundation on behalf of the mother of a dead soldier from the Altai Region, Natalia Nikolaevna Poidina. Her son, Vitaly Poidin (b. 1985), was called up to the military service on November 27, 2006, and served in M.U. 03523, Moscow. On November 3, 2007, he died in the Central Military Clinic Hospital, No. 1080. He died of the traumas received on October 30, 2007, while performing a dangerous work (he tried to change a gear-box in the Ural-4320 car). Vitaly Poidin had no qualifications for this job; he did it by the order of senior lieutenant Andrey Vikhorev who was pleaded guilty by the 94 Military Garrison Court on March 31, 2008. He was charged with negligence resulting in the death of the soldier (Article 293, s. 2, of the RF CC) and sentenced to 3 years of probation. The Mother's Right Foundation demanded that M.U. 03523 pay the mother of the deceased compensation for moral damage caused by her son's death. The interests of the mother of the deceased were represented by the Mother's Right Foundation lawyer, Tatiana Sladkova. The trial was won: the court decision obliged the military unit to pay the mother of the deceased 800,000 roubles.
3) On January 12, the North Caucasus Military District Court considered the issue of the jurisdiction of the case of Alexander Khmylnin (b. 1986). Sasha started his army service on 21.12.2004 (see p.p. 67, 103, 127). After a training camp, Vladimir Region, he served in M.U. 29483, Ingushetia, where he signed a contract. Sasha died on 22.01.2007. According to the official version, he hanged himself. The mother of the deceased did not accept the version. She thought that her son had been killed. The first trial took place in Nalchik and ended with nothing. The Mother's Right Foundation filed a request to conduct the second trial in the Stavropol Region (the Foundation lawyers can't go to Nalchik). The interests of the mother of the deceased were represented by the Mother's Right Foundation lawyer, Nadezhda Kuzina. The trial was won: the case will be tried in the Pyatigorsk Military Garrison Court (Stavropol Region).
4) On January 13, the Solnechnogorsk Garrison Court considered the lawsuit filed by the Mother's Right Foundation on behalf of Valentina Ivanovna Kanutkina from the Tambov Region (see p.p. 30, 35). Her son, Evgeny Kanutkin (b. 1986), was called up to the military service in summer 2007. After six months at the training camp, he got to the 420 training ground of the RF Military Academy, Moscow Region. He died on May 16, 2008. According to the official version, he died of a shell explosion. On September 25, 2008, the investigator of the Solnechnogorsk Garrison Court, G.V. Semiletov, refused to recognize the mother's victim status. The Mother's Right Foundation filed a complaint against his decision. The interests of the mother of the deceased were represented by the Mother's Right Foundation lawyer, Kristina Shipilina. The trial was won: the court fully satisfied the claim filed by the Mother's Right Foundation; the investigator's decision was recognized as illegal, the mother's victim status was recognized.
5) On January 13, 27, February 2, the Rostov-on-Don Military Court considered the case of the death of Andrey Dubovitsky (b. 1987) from the Krasnodar Region (the previous sessions were held on December 2, 9, 23 and 25, 2008). Andrei was called up to military service on April 23, 2007, and served in M.U. 12106, Rostov Region. He died on October 3, 2007 (see p.p. 32, 116). At first, his parents were told that Andrey's death had been caused by negligent use of a weapon (he supposedly fell asleep at his post and pulled the trigger). His parents, Nadezhda Petrovna and Oleg Anatolievich Dubovtsky, did not believe the official version. Besides the fire wounds, there were numerous bruises on his body (according to the case materials, 88!). The investigation found out that Andrey had died of constant beating on the part of Alexey Goloyad (b. 1978), corporal of M.U. 12106. It was also found out that there had been other victims in the case - Roman Gorokhov, Mikhail Tokarev, Artem Kulakov. Goloyad was charged under Articles 286 and 335 of RF CC. The interests of the father of the deceased were represented by the Mother's Right Foundation lawyer, Nadezhda Kuzina. The trial was won: Goloyad was sentenced to 4 years in a colony of general regime.
6) On January 13, the Kirov Region Court considered the cassation appeal filed by the Mother's Right Foundation on behalf of the widow of a dead serviceman, Inta Vladimirovna Zlobina. Her husband, Sergei Nikolaevich Zlobin (b. 1965), was a contract serviceman in M.U. 7487, MIA. On March 11, 1995, he was killed in Daghestan, and his death was related to his military service. His widow, Inta Vladimirovna, was a disabled person (group 3). She became disabled when she was in military service. According to the law, the widow had the right to two pensions - a disability pension and a loss-of-breadwinner pension. The MIA Pension Department of the Kirov Region refused to give her two pensions. On behalf of the widow, the Mother's Right Foundation applied to court. On October 24 2008, the Pervomaisky District Court refused to satisfy the claim. We filed a complaint against the decision. The interests of the widow of the deceased were represented by the Mother's Right Foundation lawyer, Zarema Yusupova.
7) On January 13, the Moscow Region Court considered the cassation appeal filed by the Mother's Right Foundation on behalf of the widow of a dead serviceman, Elena Yurievna Belonozhkina. Her husband, Nikolai Ivanovich Belonozhkin, served as a contract major. On August 31, 1998, he died in military service. Elena Yurievna was left with two children in her hands - Nikita (b. 1993) and Anton (b. 1987). The Central Department, No. 19, of the RF Pension Fund denied Elena Yurievna monthly payments (MPs) due to her as a widow of a serviceman who died in military service. Besides, the Pension Department stopped paying her son Nikita's MPs. The Elektrostal Social Department notified Elena Yurievna that her social certificate had lost its validity. On behalf of the widow and the son of the deceased, the Mother's Right Foundation applied to court. On June 24, 2008, the Elektrostal Town Court refused to satisfy the widow's claim. We appealed against the decision in the Moscow Region Court, which satisfied our cassation appeal on September 2, 2008 and returned the case to the court of first instance. On November 10, 2008, the Elektrostal Town Court conducted the second hearing of the case and this time the decision was positive. But instead of executing the decision, the Pension Department filed a cassation appeal. The interests of the widow of the deceased were represented by the Mother's Right Foundation lawyer, Anna Mukaseyeva.
8) On January 13, the Pskov Garrison Court considered the case of the death of Vyacheslav Ivanov (b. 1988). He was called up to military service in June 2006, and served in M.U. 74268 (ALF), Pskov. He died on May 15, 2008. His mother, Tamara Valentinovna Ivanova, was told that he had committed suicide (see p. 27). The investigation found out that his fellow serviceman, Y.A. Rybnikov, had been constantly extorting money from him. And while doing this he threatened with violence. During the investigation, Rybnikov confessed that every day he approached Ivanov and put psychological pressure on him. Vyacheslav could not stand it for long and on May 15, 2008, he hanged himself. Rybnikov was charged under Article 163 of the RF CC (extortion). The interests of the mother of the deceased were represented by the Mother's Right Foundation lawyer, Julia Lebedeva. The trial was won: Rybnikov was sentenced to two years of probation.
9) On January 15 and 30, the Cheremushkinsky District Court considered the lawsuit filed by the Mother's Right Foundation on behalf of the mother of a dead serviceman, Ludmila Mikhailovna Kopylova (see p. 59). Her son, Boris Kopylov (b. 1973), died in military service on April 9, 1992. His death was related to his military service. In August 1992, the mother of the deceased started receiving federal benefits. As a mother of a dead serviceman, Ludmila Mikhailovna received the benefits equal to those of World War Two veterans. But after January 1, 2005, when the ill-famed monetization law (federal law 122) came into force, the in-kind benefits were replaced by payments. A monthly payment of a dead serviceman's family member made up 150 roubles; a monthly payment of a war veteran made up 1050 roubles. In this situation, Ludmila Mikhailovna had to go on to a disability pension (550 roubles in 2005). The Mother's Right Foundation applied to court claiming that Kopylova should have received the sum they had not paid her because of the wrong decision. The interests of the mother of the deceased were represented by the Mother's Right Foundation lawyer, Zarema Yusupova. The trial was won: the court partially satisfied the claim - the defendant was obliged to recalculate the mother's MPs from the moment of her application to court.
10) On January 15, the Khanty-Mansiysk District Court, Khanty-Mansiysk Autonomous Area, considered the lawsuit filed by the Mother's Right Foundation on behalf of the mother of a dead serviceman, Tatiana Vladimirovna Tikhon (see p. 41). Her son, Anton Tikhon, was called up to military service on June 5, 1998, and served in M.U. 6761 (15 Special Detachment of the NCD IF MIA known as the ‘Armavir Special Forces'). On September 5, 1999, Anton's unit was sent to Daghestan under the command of Colonel-General V.G. Kazantsev. The Deputy Commander was Major-General N. A. Cherkashenko. It was Cherkashenko who worked out the plan of capturing the height with the help of the Armavir Special Forces (spetsnaz), and it was Kazantsev who approved the plan. (It took them one day to work it out.) On September 10, 1999, the generals sent the boys to battle with their communication devices discharged thus exposing them to attacks of our aviation. As a result, 9 members of the spetsnaz were dead and 23 were wounded. Among those dead was Anton Tikhon. Cherkashenko, author of this worthless operation, was found guilty under article 293 of the RF Criminal Code (negligence). Then, he was granted an amnesty and thus escaped any penalty. The Mother's Right Foundation filed a lawsuit on behalf of the mother of the deceased. We demanded that the Ministry of Finance pay for the guilty actions of an official of the Ministry of Defense. The interests of the mother of the deceased were represented by the Mother's Right Foundation lawyer, Tatiana Sladkova. The trial was won: the claim of the Mother's Right Foundation was satisfied with 1,000,000 roubles settlement.
11) On January 15, the Moscow Region Court considered the cassation appeal against the decision issued by the Serebryanoprudsky District Court in favour of the mother of a dead serviceman, Elena Nikolaevna Myasina. Her son, Sergei Myasin (b. 1981), was called up to military service on June 15, 1999, and served in M.U. 61896. On January 5, 2000, he was killed in Chechnya. He died in military service. His mother started receiving federal benefits after April 2, 2001. When the ill-famed ‘monetization law' came into force, they stopped paying her MPs though these payments should have been calculated automatically, without her application. Elena Nikolaevna knew about it only in April 2008. She applied to Pension Department No. 35, Moscow and the Moscow Region, but was refused. The Mother's Right Foundation filed a claim demanding that the Department pay MPs to the mother of the soldier who had perished in Chechnya. On September 26, 2008, the court issued the decision satisfying our claim. But the defendant, Pension Department 35, Moscow, filed a cassation appeal in the Region Court. The interests of the mother of the deceased were represented by the Mother's Right Foundation lawyer, Anna Mukaseyeva. The trial was won: the decision of the court of first instance was left in force; the cassation appeal of the defendant was denied.
12) On February 2, 9, and 24, the Vladivostok Garrison Court considered the case of the death of Mikhail Metelev (b. 1984) from Kirov (see p. 100). He was a contract sergeant in M.U. 73091, and served as a torpedo artificer in submarine B-345. On February 21, 2008, he died performing a dangerous job - he tried to open the lids of torpedoes. The charge was brought against the Senior Assistant of the Commander of M.U. 73031, captain of 3 rank, Andrey Viktorovich Koleda, and the Commander of M.U. 73031, captain-lieutenant, Alexander Alexandrovich Krasnov, under Article 286, s. 3, of the RF CC (abuse of authority resulting in death). Mikhail Metelev was an orphan. His only relative was his sister, Ludmila Kleptsova. The interests of the sister of the deceased were represented by the Mother's Right foundation lawyer, Kristina Shipilina. The trial was won: Koleda was sentenced to 2 years in a penal colony, Krasnov was justified. (The Foundation filed an appeal against the mild sentence - see the 2010 Report, first six months).
13) On January 19 and April 27, the Suvorovsky District Court, Suvorov Town, Tula Region, considered the lawsuit filed by the Mother's Right Foundation on behalf of the mother of a dead serviceman, Tatiana Borisovna Pakhtina (b. 1960). Her son, Vitaly Pakhtin (b. 1983), was called up to military service on May 31, and served in M.U.77117. On March 17, 2003 he died in military service (see p. 38). Vitaly's mother was a disabled person (group 2). She had to live on her disability pension. In March 2006, she applied to the local Pension Department with the request to grant her a loss-of-breadwinner pension as the second pension. The Pension Department of Suvorov Town denied it. The Mother's Right Foundation decided to appeal against their decision. The interests of the mother of the deceased were represented by the Mother's Right Foundation lawyer, Tatiana Sladkova.
14) On January 20, the Moscow City Court considered the cassation appeal filed by the Mother's Right Foundation on behalf of the mother of a dead serviceman from Ingushetia, Aset Israilevna Goigova. Her son, Alik Goigov (b. 1985) was called up to military service in May 2003, and served in M.U. 3768 (MIA). On January 26, 2004, he died at the hands of his fellow serviceman, Alexei Chaschin. They found 63 stab wounds on his body. Chaschin was sentenced to 3 years and 8 months in a colony. The mother of the deceased demanded that the Ministry of Internal Affair pay her compensation for the moral damage caused by her son's death. On October 29, the Zamoskvoretsy District Court denied the mother's claim. We filed a cassation appeal against the decision. The interests of the mother of the deceased were represented by the Mother's Right Foundation lawyer, Tatiana Sladkova.
15) On January 21, February 4, and March 26, the Meschansky District Court, Moscow, considered the lawsuit filed by the Mother's Right Foundation on behalf of the widow of the Hero of the Russian Federation from Moscow, Natalia Georgiyevna Rumyantseva, and her underage son, Vadim (b. 2004). Her husband, captain Alexei Viktorovich Rumyantsev (b. 1980), served in M.U. 28337 (ALF, 45 Reconnaissance Regiment, Chechnya). He perished on October 5, 2004. During their raid, the advanced patrol (under the command of Rumyantsev) saw a large detachment of well-armed guerrillas. The main group consisting of 30 guys followed the patrol. In order to save them, Rumyantsev decided to start fire. The members of the vanguard patrol were killed, and the main group was saved. On May 24 2005, Alexey Rumyantsev was awarded the title of Hero of the Russian Federation.
According to the law, the widow and the son of the deceased had the right to increased (100%) loss-of-breadwinner pensions. But the Moscow Military Commissariat denied them their increases pensions. They used their favourite excuse: the pension was due to Rumyantsev himself if he had been alive. On behalf of his widow and son, we filed a lawsuit. Their interests of the widow and son of the deceased were represented by the Mother's Right Foundation lawyer, Anna Mukaseyeva. The trial was won: the court recognized the widow and child's right to increased loss-of-breadwinner pensions, and obliged the Military Commissariat to grant those pensions to them.
16) On January 22, the Istra Town Court, Moscow Region, considered the lawsuit filed by the Mother's Right Foundation on behalf of the parents of a dead serviceman, Tatiana Ivanovna and Gennady Maximovich Kostitsyn. Their son, Mikhail Kostitsyn, was called up to military service on November 15, 1987, and served in M.U. 58362. He died in the Burdenko hospital on April 17, 1989 (see p. 47). His death was related to his military service. Pension Department 27, Moscow and the Moscow Region, denied the parents increased loss-of-breadwinner pensions (from 150% to 200% of their basic service pensions). The parents knew about their right when they were consulted by our lawyer. They motivated their denial by the fact that the serviceman had died of an illness during his service. On behalf of the parents of the deceased, the Mother's Right Foundation applied to court. In May 2008, we won the trial in favour of the Kostitsyns (the defendant agreed to satisfy our claim). The interests of the parents of the deceased were represented by the Mother's Right Foundation lawyer, Anna Mukaseyeva.
17) On January 26, the Chertanovsky District Court, Moscow, considered the case of Valentina Petrovna Shustova's right to a loss-of-breadwinner pension (see p. 54). Her son, Evgeny Shustov (b. 1986), was called up to military service on November 26, 2004, and served in M.U. 54607. During his service he signed a contract and was sent to Chechnya. On June 4, 2006, he was killed in battle. After his death, the mother was recognized as a disabled person (group 2) and was granted a disability pension. In November 2007, she applied to the Moscow Military Commissariat for a loss-of-breadwinner pension (according to the law, she had the right to receive it as the second pension). The Commissariat denied her application. The Mother's Right Foundation applied to the Chertanovsky District Court, which satisfied the claim of the mother of the deceased on March 11, 2008. On September 18, 2008, the decision was cancelled by the Moscow City Court and the case was returned to the court of first instance for retrial. The interests of the mother of the deceased were represented by the Mother's Right Foundation lawyer, Zarema Yusupova. The trial was won: the court recognized the mother's right to a loss-of-breadwinner pension, and obliged the defendant to grant the pension from November 2006 when she was recognized as a disabled person.
18) On January 27, the Moscow Region Court considered the cassation appeal filed by the Mother's Right Foundation on behalf of a dead serviceman, Lidia Alexandrovna Tatarinova. Her son, Igor Tatarinov (b. 1968), was called up to military service on October 23, 1986, and served in M.U. 35145L, Germany. During his service he fell ill; he suffered from asthmatic fits. The unit officers did not pay attention to his illness. When his fits became stronger, Sergey was sent home. It was found out that during his service Sergey had got the infectious allergic myocarditis. On October 3, 1988, he died. 17 years have passed, and the Pension Department still denies the mother of the deceased a loss-of-breadwinner pension. The Mother's Right Foundation applied to court, but courts of first and second instances denied the mother's application. The Mother's Right Foundation prepared an extraordinary complaint but on April 2, 2008, the Moscow Region Court returned it to Tatarinova - the panel of judges decided that the mother of the deceased had missed the appeal deadline. The Mother's Right Foundation filed a cassation appeal against the decision. The interests of the mother of the deceased were represented by the Mother's Right Foundation lawyer, Zarema Yusupova. The trial was won: the court restored the extraordinary appeal deadline.
19) On January 27, the Nizhny Novgorod Region Court considered the cassation appeal filed by the Military Commissariat of the Nizhny Novgorod Region against the decision of 13.11.2008 passed by the Nizhegorodsky District Court, Nizhny Novgorod, which had denied the Commissariat's request to restore the cassation deadline. The Commissariat was going to appeal against the decision passed in favour of the father of a dead serviceman, Vasily Dmitrievich Zhidkov. His son, Dmitry Zhidkov (b. 1981), served in the 45 Special Reconnaissance Regiment (see p. 21). The Military Commissariat denied Vasily Dmitrievich's request to increase his loss-of-breadwinner pension by 100%. On behalf of the father of the deceased, the Mother's Right Foundation applied to court and won the case (earlier we filed a claim against the same Commissariat and won the case of Dmitry Zhidkov in courts of all instances including the RF Supreme Court). The interests of the father of the deceased were represented by the Mother's Right Foundation lawyer, Anna Mukaseyeva.
20) On February 4, the Khabarovsk Region Court considered the cassation appeal against the decision issued by the Khabarovsky District Court of November 5, 2008 in the case of Lubov Georgievna Vorozhtsova from the Kemerovo Region. Her son, Dmitry Vorozhtsov (b. 1983), was called up to military service on May 30, 2002, and served in M.U. 34091, Khabarovsk Region. He died on June 5, 2002. The Mother's Right Foundation won the case of compensation for moral damage caused to Lubov Georgievna by her son's death. The decision came into force on August 20, 2006, but the Ministry of Defense delayed the execution of the decision and paid compensation on May 21, 2008. Then, the Mother's Right Foundation filed a claim on behalf of the mother of the deceased: we demanded that the compensation be indexed. On November 5, 2008 we won the trial and our claim was satisfied. According to our calculations, the defendant was to pay Lubov Georgievna 46,500 roubles. Instead of executing the decision, the Ministry of Defense filed a cassation appeal. The trial was won: the decision of the court of first instance was left in force; the defendant's cassation appeal was denied.
21) On February 5, the Judicial Board of the RF Supreme Court considered the supervision appeal filed by the Mother's Right Foundation against the decision of December 21, 2007 passed by the Kiznersky District Court, Republic of Udmurtia, the decision of February 6, 2008 issued by the Judicial Board on Civil Cases of the Supreme Court of Udmurtia, and the decision issued by the judge of the Supreme Court of the Republic of Udmurtia, L.N. Korobeinikova. All these decisions denied the parents of a dead soldier, Valentina Petrovna and Vyacheslav Nikolayevich Yermakov, measures of social support. Their son, Mikhail Yermakov (b. 1985), died in military service on October 1, 2005 (see p.p. 60, 77). As his death was related to his military service, his parents had the right to measures of social support under the Law "On Veterans", Article 21, s. 3. These measures are rendered to persons possessing certificates (the Yermakovs had such certificates). The Pension Department of the Kiznersky District, Udmurtia, denied the parents of the deceased its part of social measures, namely monthly payments. On behalf of the parents of the deceased, the Mother's Right Foundation applied to court. Together with the parents, we went through courts of all instances in Udmurtia and then applied to the RF Supreme Court. The interests of the parents of the deceased were represented by the Mother's Right Foundation lawyer, Zarema Yusupova. The trial was won: the court satisfied the claim and cancelled the decisions of the courts of three instances and returned the case for retrial.
22) On February 5, The Reutov Garrison Court considered the lawsuit filed by the Mother's Right Foundation on behalf of the mother of a dead serviceman, Natalia Alexandrovna Nalezhinskaya. Her son, Alexander Nalezhinsky (b. 1986), served as a sergeant in M.U. 3270, Elektrostal Town. On September 16, 2006, 2:00 A.M., he died in a car accident. Lieutenant A.A. Plusnin was charged under Article 350, s. 3, (infringement of driving rules which caused death of two or more people - along with Alexander Nalezhinsky died his fellow serviceman, Rukosuyev). On August 14, 2007, the Reutov Garrison Court sentenced Plusnin to 1 year of probation. Also, the court satisfied the claim against M.U. 3270 and obliged the defendant to pay the mother of the deceased 8090 roubles as compensation for material damage and 200,000 roubles as compensation for moral damage caused by her son's death. The decision came into force on August 25, 2007, but the unit delayed the execution of the decision till March 20, 2008. On behalf of the mother of the deceased, the Mother's Right Foundation claimed to index the compensation. According to our calculations, the unit was to pay the mother of the deceased 20184 roubles and 73 kopeks. The interests of the mother of the deceased were represented by the Mother's Right Foundation lawyer, Tatiana Sladkova. The trial was won: the court fully satisfied the Foundation's claim.
23) On February 9, the Tyumen Region Court considered the cassation appeal filed by the Mother's Right Foundation on behalf of a dead serviceman, Maria Dmitrievna Potanina. The appeal was filed against the decision passed by the Uporovsky Disrtrict Court, Tyumen Region. Her son, Sergei Potanin (b. 1977), served in M.U. 51436 where he died on June 25, 1996 (see p.72). Maria Dmitrievna (b. 1954) had had the right to a loss-of-breadwinner pension since April 15, 2004 but she knew about it only in December 2006, during the consultation at the Mother's Right Foundation. The mother applied to the Pension Department. According to the law, the mother should have been paid pensions for 12 months preceding the date of application. The Pension Department of the Uporovsky District, Tyumen Region, granted a pension from the date of application and refused to pay for the previous year. On behalf of the mother of the deceased, the Mother's Right Foundation applied to the Uporovsky District Court. On June 2, 2008 the case was tried, and the mother's claim was denied. We appealed against the decision on August 6, 2008, and the cassation instance satisfied our cassation appeal and returned the case for retrial. But on October 22, 2008, the Uporovsky District Court once again denied the mother's claim The Mother's Right Foundation again filed a cassation appeal against the decision of the court of first instance. The interests of the mother of the deceased were represented by the Mother's Right Foundation lawyer, Anna Mukaseyeva.
24) On February 11 and 18, the Meschansky District Court, Moscow, considered two lawsuits filed by the Mother's Right Foundation on behalf of the widow and son of a dead serviceman, Nina Ivanovna Tribuntsova and Igor Igorevich Tribuntsov (b. 1989). Their husband and father, Igor Tribuntsov served as a colonel in M.U. 52715. He served in Afghanistan and died in military service in Chechnya on September 17, 2001 (see p. 81). The widow and son of the deceased received loss-of-breadwinner pensions (40% of the serviceman's payment) but they had the right to increased pensions. In September 2008, the widow applied to the Moscow Military Commissariat with the request to recalculate her pensions and the pensions of her son. On October 13, 2008, the Commissariat denied her application on the ground that an increased pension was due to Igor Tribuntsov himself if he had been alive. The interests of the widow and son of the deceased were represented by the Mother's Right Foundation, Zarema Yusupova. The trial was won: the Commissariat was obliged to grant increased loss-of-breadwinner pensions and pay the debts: 17,121 roubles - to the widow and 63,000 roubles - to the son.
25) On February 12, the Leninsky District Court, Tambov City, reconsidered the lawsuit filed by the Mother's Right Foundation on behalf of the parents of a dead serviceman, Lubov Nikolaevna and Alexander Petrovich Zhirkov. Their son, Vladimir Zhirkov (b. 1982), served in M.U. 54096. He died on September 24, 2000 and according to the death certificate, his death was related to his military service. As parents of a serviceman who died in military service, the Zhirkovs had the right to measures of social support under the law "On Veterans". They also had the right to monthly payments. In 2004, the Zhirkovs received corresponding certificates and received the benefits. But on August 1, 2008, the Labour and Social Department issued an order according to which on August 8, 2008 they confiscated the parents' certificates. At the same time the Pension Department stopped paying their monthly payments. On November 6, 2008 the Mother's Right Foundation won the case in favour of the Zhirkovs at the Leninsky District Court but the Pension Department filed a cassation appeal. On December 22, 2008 it was considered at the Tambov Region Court and the decision was cancelled for technical reasons. The case was returned to the court of first instance for retrial. The interests of the parents of the deceased were represented by the Mother's Right Foundation lawyer, Zarema Yusupova. The trial was won: the court fully satisfied the claim filed by the Foundation, restored the Zhirkovs' rights, obliged the Social Department to give certificates to the parents, obliged the Pension Department to grant monthly payments and pay the debt from August 2008.
26) On February 17 and 24, the Perovsky District Court, Moscow, considered the lawsuit filed by the Mother's Right Foundation on behalf of the parents of a dead serviceman, Valentina Alexeyevna and Anatoly Andreyevich Dergunov. Their son, Andrei Dergunov (b. 1975), served in M.U. 29483. He died in military service in Chechnya on January 8, 1995 (see p. 55). In 1996, the parents of the deceased received their benefit certificates and received the benefits equal to those of World War Two veterans under Article 7 of the USSR Law No. 313-1 "Measures Improving Pension and Social Security", August 1, 1989. After the adoption of Federal Law No. 122 ("monetization law"), the benefits were replaced by measures of social support, including monthly payments amounting to 150 roubles while war veterans were granted monthly payments amounting to 1050 roubles. Thus, the social position of the parents of the deceased worsened. The Mother's Right Foundation filed a lawsuit demanding to recognize the parents' right to monthly payments equal to those of World War Two veterans and to oblige Pension Department 7, Moscow and the Moscow Region, to grant these payments from April 4, 2007. The trial was won: the court obliged the defendant to recalculate the monthly payments of the parents of the deceased.
27) On February 26, the Leningradsky Military District Court considered the cassation appeal filed by the Mother's Right Foundation on behalf of the mother of a dead serviceman, Tamara Valentinovna Ivanova. Her son, Vyacheslav Ivanov died on May 15, 2008 (see p. 8). On December 15, 2008, judge of the Pskov Garrison Court, Y.M. Kuntsevich, acting as chairman in the case of Rybnikov denied the mother's complaint against the investigator's decision of October 13, 2008. The investigator's decision denied the mother's appeal to re-qualify Rybnikov's actions from Article 163 of the RF CC (extortion) to Article 110 of the RF CC (driving to suicide). The Mother's Right Foundation filed a cassation appeal against the decision of judge Kutsevich. The interests of the mother of the deceased were represented by the Mother's Right Foundation lawyer, Julia Lebedeva.
28) On March 5, the Elektrostal Town Court considered the lawsuit filed by the Mother's Right Foundation on behalf of the parents of a dead serviceman, Lubov Petrovna and Sergei Nikolaevich Baryshnikov. Their son, Andrei Baryshnikov (b. 1976), was called up to military service on June 11, 1995, and served in M.U. 2114, Leningrad Region. On January 1, 1996, he died of cranio-cerebral trauma inflicted by a senior serviceman (see p.51). His death was related to his military service. After their son's death, the parents received certificates confirming their right to measures of social support authorized for parents of dead servicemen. On July 15, 2008, the officials of the Elektrostal Social Department decided to stop paying their part of social measures - the parents' monthly payments. On behalf of the parents of the deceased, the Mother's Right Foundation applied to court. The interests of the parents of the deceased were represented by the Mother's Right Foundation lawyer, Anna Mukaseyeva. The trial was won: the court recognized the parents' right to measures of social support and monthly payments and obliged the defendant to grant the Baryshnikovs these measures.
29) On March 6 and May 21, the Timsky District Court, Kursk Region, considered the lawsuit filed the Mother's Right Foundation on behalf of the mother of a dead serviceman, Svetlana Nikolaevna Bondareva. Her son, Evgeny Bondarev (b. 1986), was called up to military service on December 19, 2007, and served in M.U. 3792, the kinological centre, Moscow. On February 16, 2008, he died (p. 94). His mother was informed that her son had allegedly ‘committed suicide' by hanging himself with a dog's lead. The unit commander wrote in his letter: ‘There have not been found any other injuries on the body, except a strangulation furrow. We have not found out any facts of hazing.' But during the trial of the case of Alexey Tulsky, corporal of the same unit who was guilty in Evgeny Bondarev's death (he was sentenced to 4 years of imprisonment under Article 335, s. 3, of the RF CC) they announced the results of the medico-legal investigation which stated that there had been numerous scratches and bruises on the boy's body. The Mother's Right Foundation claimed that the mother of the deceased be paid compensation for moral damage caused by her son's death. The defendants: the Military Commissariat of the Timsky District, Kursk Region; M.U. 3792, Ministry of Internal Affairs of Russia; Ministry of Finance. The interests of the mother of the deceased were represented by the Mother's Right Foundation lawyer, Tatiana Sladkova. The trial was completed: according to the decision, M.U. 3792 was obliged to pay the mother of the deceased 100,000 roubles as compensation for moral damage caused by her son's death, and 10,737 roubles as compensation for material damage.
30) On March 10, the Moscow Military District Court considered the cassation appeal filed by the Assistant Prosecutor of the Solnechnogorsk Garrison, V.V. Evseyev, against the decision passed by the Solnechnogorsk Garrison Court (Moscow Region) on January 13, 2009. The decision was issued on the complaint filed by the Mother's Right Foundation against the actions of the investigator, Gennady Viktorovich Semiletov, who had refused to recognize the mother of a dead soldier, Valentina Ivanovna Kanutkina, as a victim (see p. 4, p. 35). Her son, Evgeny Kanutkin, died on May 16, 2008 (see p.4). On September 25, 2008, the investigator, G.V. Semiletov, refused to recognize the victim status of the mother of the deceased, which was the violation of Kanutkina's rights. The Mother's Right Foundation filed an appeal against the investigator's denial. Of course, we won the case, and the investigator's denial was recognized as illegal. It seemed that everything had been put in order but the officials of the investigation body filed a cassation appeal against the decision of the court of first instance. The interests of the mother of the deceased were represented by the Mother's Right Foundation, Zarema Yusupova. The trial was won: the panel of judges issued the decision according to which Evseyev's decision was not satisfied, and the decision of the court of first instance was left in force.
31) On March 12, the Moscow Region Court considered the cassation appeal filed by the unit officers of M.U. 03523 against the decision issued by the Pushkin Town Court on the claim of the Mother's Right Foundation. The decision was passed in favour of the mother of a dead serviceman from the Altai Region, Natalia Nikolaevna Poidina. Her son, Vitaly Poidin, died in hospital on November 3, 2007 (see p. 2). The Mother's Right Foundation demanded that M.U. 03523 pay the mother of the deceased compensation for moral damage caused by her son's death, and won the case on January 12, 2009. Natalia Nikolaevna was to receive 800,000 roubles. Instead of paying the compensation, the defendant filed a cassation appeal. The interests of the mother of the deceased were represented by the Mother's Right Foundation lawyer, Tatiana Sladkova. The trial was won: the positive decision issued by the court of first instance was left in force.
32) On March 12, 26, and April 16, the North Caucasus Military District Court considered the cassation appeals filed against the decision passed by the Rostov-on-Don Garrison Court in the case of Andrei Dubovitsky (see p.p. 5, 16). The investigation found out that Andrei had shoot himself because of the constant humiliation and beating on the part of the corporal of M.U. 12106, Alexey Goloyad (b. 1978). On February 2, 2009, Goloyad was sentenced to 4 years of imprisonment under Articles 286 and 335 of the RF CC, and the sentence did not satisfy all parties of the trial. The interests of the father of the deceased were represented by the Mother's Right Foundation lawyer, Kristina Shipilina. The trial was completed: the decision of the court of first instance was left in force.
33) On March 19, April 1, and May 20, the Krasnoarmeisky District Court, Krasnodar Region, considered the lawsuit filed by the Mother's Right Foundation on behalf of the parents of a dead serviceman, Tamara Grigorievna and Vasily Grigorievich Zhuravlev. Their son, Vitaly Zhuravlev (1979), served as a contract captain in M.U. 20004. On October 30, 2007, he died of an ailment. His death was related to his military service. According to Article 21, s. 3, of the Federal Law "On Veterans", his parents had the right to measures of social support authorized for members of families of servicemen who died in military service. On March 19, 2008, the parents of the deceased applied to the Military Commissariat of the Krasnoarmeisky District, Krasnodar Region, for certificates confirming their right to measures of social support but their application was denied. The interests of the parents of the deceased were represented by the Mother's Right Foundation lawyer, Zarema Yusupova.
34) On March 23, the 3 Military District Court considered the cassation appeal filed by the Mother's Right Foundation against the decision issued by the 101 Garrison Court on December 22, 2008 (judge R.M. Rachapov) according to which Nabilya Mustafeyevna Galeyeva was denied the right to have the cassation deadline restored. She wanted to appeal against the decision issued by the 101 Garrison Court on 16.10.08 (denial of the particular complaint against the investigator's decision to stop the investigation of the case). Nabilya Mustafeyevna's son, Denis Galeyev, was called up to military service in December 2005, and served in M.U. 54203, Sverdlov Region (strategic missile forces). On March 12, 2007, he died (see p.p. 43, 62, 111, 131). The military officials told his mother that Denis had "committed suicide" but she did not believe the official version. She found injuries on his body. The investigation of the case ended with nothing - they decided to stop the trial. The Mother's Right Foundation decided to appeal against the investigator's decision but the court of first instance refused to satisfy the particular complaint against the investigator's decision, and then - to restore the cassation deadline. The interests of the mother of the deceased were represented by the Mother's Right Foundation lawyer, Zarema Yusupova. The trial was won: the panel of judges cancelled the decision passed by judge Rachapov and returned the case for retrial.
35) On March 24, the Morshansky District Court, Tambov Region, considered the lawsuit filed by the Mother's Right Foundation on behalf of the parents of a dead serviceman, Valentina Ivanovna and Alexander Alexandrovich Kanutkin. Their son, Evgeny Kanutkin, died on May 16, 2008 (see p.p. 4, 30). After their son's death, the parents applied to the Labour and Social Department of the Tula Region with the request for certificates confirming their right to measures of social support authorized for parents of servicemen who died in military service. But the officials responsible for social issues denied the parents their certificates. On behalf of the parents of the deceased, the Mother's Right Foundation applied to court. The interests of the parents of the deceased were represented by the Mother's Right Foundation lawyer, Zarema Yusupova. The trial was won: the court recognized the parents' right to measures of social support and obliged the defendant to give them corresponding certificates.
36) On March 24, April 9, May 6, and June 10, 29, the Krasnogvardeisky District Court, St. Petersburg, considered the lawsuit filed by the Mother's Right Foundation on behalf of the aunt of a dead serviceman, Ludmila Vladimirovna Gromova. Her nephew, Denis Panasenko (b. 1987), was called up to military service from Orel on November 16, 2006, and served in M.U. 43117, St. Petersburg. On July 19, 2007, he died in hospital of numerous injuries caused by the fall from the fifth floor of the unit's building (see p. 106). The investigation found out that Denis had been driven to suicide by his fellow serviceman, Nikolai Rodionov. On December 13, 2007, the St. Petersburg Garrison Court sentenced Rodionov to 4.5 years of imprisonment under Article 335, s. 3, of the RF CC. Denis was an orphan when he went to the army, and it was his aunt who was recognized as victim. We represented her interests in the trial. The Mother's Right Foundation demanded that M.U. 43117, the Federal Agency of Special Construction, and the RF Ministry of Finance pay the aunt of the deceased compensation for moral damage caused by Denis' death. The interests of the aunt of the deceased were represented by the Mother's Right Foundation lawyer, Tatiana Sladkova. The trial was won: according to the court decision, M.U. 43117 was obliged to pay the aunt of the deceased 400,000 roubles as compensation for moral damage caused by her nephew's death.
37) On April 1, 28, May 25, June 24, and July 24, the Presnensky District Court, Moscow, considered the lawsuit filed by the Mother's Right Foundation on behalf of the parents of a dead serviceman, Railya Gilmukhanovna and Alik Dautovich Mratov. Their son, Aidar Mratov (b. 1988), served in M.U. 02014, where he died in a car accident on December 28, 2007 (see p.p. 68, 96, 124). The Mother's Right Foundation demanded that the parents of the deceased receive compensation for moral damage caused by their son's death. The interests of the mother of the deceased were represented by the Mother's Right Foundation lawyer, Tatiana Sladkova. The trial was won: according to the court decision, the Military Unit was obliged to pay the parents of the deceased 200,000 roubles.
38) On April 2, the Tula Region Court considered the cassation appeal filed by the Pension Department of the Suvorovsky District Court, Tula Region, against the court's decision of January 19, 2009 which satisfied the claim filed by the Mother's Right Foundation on behalf of the mother of a dead soldier, Tatiana Borisovna Pakhtina. In her application the mother of the deceased asked to send her case to the Constitutional Court of the RF. Tatiana Borisovna's son, Vitaly Pakhtin died on March 17, 2003 (see p. 13). During the court session of January 19, 2009, the defendant's representative did not object to sending the case to the Constitutional Court of the RF, and the decision of the court of first instance was not appealed before the deadline. Then, the idea of sending the case to the Constitutional Court of the RF caused the defendant's sudden resistance. The interests of the mother of the deceased were represented by the Mother's Right Foundation lawyer, Tatiana Sladkova.
39) On April 3, the Kamyshin Town Court, Volgograd Region, considered the lawsuit filed by the Mother's Right Foundation on behalf of a dead serviceman, Alexander Ivanovich Pchelintsev. His son, Dmitry Pchelintsev (b. 1973), was called up to military service in summer 1991, and served in M.U. 41711. On December 29, 1992, he died, and his death was related to his military service (see p. 74). After his son's death, Alexander Ivanovich received two pensions - a loss-of-breadwinner pension and a retirement pension granted by the Military Commissariat of the Sverdlov Region, Ministry of Defense. When he changed his residence (he went from the Sverdlov Region to the Volgograd Region), they stopped paying a loss-of-breadwinner pension. The Pension Department of Kamyshin Town and the Kamyshinsky District did not register his pension record and returned it to Yekaterinburg. On behalf of the father of the deceased, the Mother's Right Foundation applied to court.
40) On April 3 and 8, the Zheleznodorozhny District Court, Ulyanovsk, considered the lawsuit filed by the Mother's Right Foundation on behalf of the mother of a dead serviceman, Tatiana Leonidovna Trofimova. Her son, Leonid Sveshnikov (b. 1982), was called up to military service on November 24, 2000, and served in M.U. 93915. On July 8, 2001, he died of an ailment while in military service. According to the law, his mother had the right to measures of social support authorized for parents of servicemen who died in military service. She was granted these measures from May 2002 but the Pension Department of the Zheleznodorozhny District, Ulyanovsk, stopped paying her monthly payments (their part of the social measures). On behalf of the mother of the deceased, the Mother's Right Foundation applied to court. The trial was won: the court recognized the mother's right to monthly payments and obliged the Pension Department of the Zheleznodorozhny District, Ulyanovsk, to resume the payment of Trofimova's monthly payments from the moment of its cessation, i.e. May 1, 2007.
41) On April 7, the Region Court of the Khanty-Mansiysk Autonomous Area considered the lawsuit filed by representatives of the RF Ministry of Finance against the decision passed by the Khantymansiysky District Court, Khanty-Mansiysk AA, in favour of the mother of a dead serviceman, Tatiana Vladimirovna Tikhon. Her son, Anton Tikhon died on September 11, 1999 (see p. 10). On behalf of the mother of the deceased, the Mother's Right Foundation filed a claim for compensation for moral damage and demanded that the Ministry of Finance pay for the guilty actions of a representative of the RF Ministry of Defense. On January 15, 2009, we won the case in the court of first instance (according to the decision, the defendant was obliged to pay 1,000,000 roubles to the mother of the deceased), but the Ministry of Finance filed a cassation appeal. The trial was won: the cassation appeal was denied; the decision passed by the court of first instance in favour of the mother of the deceased was left in force.
42) On April 7, the JP of Сourt 99, Kuedinsky District, Perm Region, considered the claim filed by the Mother's Right Foundation on behalf of the parents of a dead serviceman, Margarita Gennadievna and Nikolai Alexandrovich Terebov. Their son, Dmitry Terebov (b. 1979), served in M.U. 30672. On November 1998, he died in military service (see p. 108). The parents of the deceased had the right to measures of social support under Article 21 of the Federal Law "On Veterans". Before March 1, 2006, the parents had been enjoying the measures of social support but after that date, the Pension Department of the Kuedinsky District stopped paying their monthly payments. The Mother's Right Foundation lawyers wrote a statement of claim. The trial was won: the court obliged the defendant to grant the Terebovs monthly payments and pay the debt from the date of cessation of payments.
43) On April 9, the 101 Garrison Court reconsidered the lawsuit for restoring the cassation deadline. The claim was filed by the Mother's Right Foundation on behalf of the mother of a dead serviceman, Nabilya Mustafeyevna Galeyeva. Her son, Denis Galeyev died on March 12, 2007 (see p.p. 34, 62, 111, 131). The Court of first instance denied the particular complaint against the investigator's decision to stop the trial of the case; then the application for restoring the cassation deadline. We filed a cassation appeal against the denial, and won the case on March 23, 2009: the panel of judges returned the case to the court of first instance for retrial. The interests of the mother of the deceased were represented by the Mother's Right Foundation lawyer, Zarema Yusupova. The trial was won: this time the court restored the cassation deadline.
44) On April 10, the Furmanovsky District Court, Ivanov Region, considered the lawsuit filed by the Mother's Right Foundation on behalf of the parents of a dead serviceman, Irina Leontievna and Alexander Mikhailovich Zemlyanichkin. Their son, Mikhail Zemlyanichkin (b. 1988), was called up to military service on December 20, 2006, and served in the 127 Auto Base of the RF Ministry of Defense. On January 6, 2008, he died in military service. His parents had the right to measures of social support authorized for parents of servicemen who died in military service. In March 2008, the Social Department of the Furmanovsky Municipal District gave them the corresponding certificates. But on December 23, 2008, the Social Department officials "changed their minds" and took away the parents' certificates, and the Pension Department stopped paying their monthly payments. On behalf of the parents of the deceased, the Mother's Right Foundation applied to court. The trial was won: the court obliged the defendant to give the parents of the deceased certificates confirming their right to measures of social support.
45) On April 13, the Leninsky District Court considered the lawsuit filed by the Mother's Right Foundation on behalf of the parents of a dead serviceman, Galina Viktorovna and Viktor Nikolayevich Titov. Their son, Nikolai Titov (b. 1986), served in M.U. 32477. Nikolai died in military service on March 22, 2006 (see p.p. 83, 105). According to Article 21, s. 3, of the Federal Law "On Veterans", his parents had the right to measures of social support rendered upon presentation of certificates. But the Military Commissariat of the Sverdlov Region refused to give such certificates to the Titovs. On behalf of the parents of the deceased, the Mother's Right Foundation filed a lawsuit. The trial was won: the court recognized the Titovs' right to measures of social support, and obliged the Commissariat to give them their certificates.
46) On April 13 and May 7, the Oktyabrsky District Court, Jewish Autonomous Area, considered the lawsuit filed by the Mother's Right Foundation on behalf of the mother of a dead serviceman, Nadezhda Grigorievna Filippova (b. 1957). Her son, Sergey Filippov (b. 1981), died on April 13, 2001. He died of an ailment while in military service. According to the law, Nadezhda Grigorievna had the right to a loss-of-breadwinner pension along with her retirement pension granted on April 21, 2006 by the MIA. But the Pension Department of the Oktyabrsky District, JAA, refused to grant Nadezhda Grigorievna a loss-of-breadwinner pension. On behalf of the mother of the deceased, the Mother's Right Foundation applied to court.
47) On April 14, the Moscow Region Court considered the lawsuit filed by the Mother's Right Foundation on behalf of the parents of a dead serviceman, Tatiana Ivanovna and Gennady Maximovich Kostitsyn. Their son, Mikhail Kostitsyn, died in the Burdenko hospital on April 17, 1989 (see p. 16). On January 22, 2009, the Istra Town Court refused to satisfy the claim of the parents of the deceased. We filed a cassation appeal against the decision. The interests of the parents of the deceased were represented by the Mother's Right Foundation lawyer, Anna Mukaseyeva.
48) On April 14, the Avtozavodsky District Court, Tolyatti, Samara Region, considered the lawsuit filed by the Mother's Right Foundation on behalf of the mother of a dead serviceman, Irina Valerievna Bamburova. Her son, Sergey Bamburov (b. 1982), was called up to military service on June 17, 2000, and served in M.U. 86373. On September 4, 2001, he died in military service. As a mother of a serviceman who died in military service, Irina Valerievna had the right to measures of social support, including monthly payments. But the local Pension Department denied the application of the mother of the deceased. The Mother's Right Foundation applied to court. The trial was won: the court recognized the mother's right to social support, and obliged the defendant to grant her monthly payments.
49) On April 15, May 12, 25, and June 1, the Orenburg Garrison Court considered the case of the death of Roman Viktorovich Semenov from Penza (see p.p. 80, 84). Roman Semenov was 37. He was a law obeying citizen. He was the head of the family - he had a wife and two children, Katya and Maxim. He worked. He paid taxes. He paid his credit for car purchase. Then he was summoned to reservist camp. On September 2, 2008, he was transported there from his working place, and on September 12, his wife received "cargo 200" - his body with numerous injuries... The charge was brought against the doctor of the military train, Alexander Nikolaevich Ivanov. The interests of the widow of the deceased were represented by the Mother's Right Foundation lawyer, Julia Lebedeva. The trial was completed: doctor Ivanov was sentenced to 2 years of probation; the military unit was obliged to pay the widow of the deceased 150,000 roubles as compensation for moral damage caused by her husband's death.
50) On April 21, and May 12, 21, the Sovetsky District Court, Samara, considered the lawsuit filed by the Mother's Right Foundation on behalf of the parents of a dead serviceman, Sofia Tagirovna and Ryauf Valiyevich Shakirov. Their son, Marat Shakirov (b. 1969), died in military service on September 25, 1990 (see p. 71). After their son's death, the parents enjoyed the benefits authorized under Article 7 of the USSR Law No. 313-1, August 1, 1989, according to which the benefits of parents of dead servicemen were equal to those of World War Two veterans. Law 122 (monetization law) replaced a part of the in-kind benefits by monthly payments. The Shakirovs were granted 150 roubles, while war participants were granted 1050 roubles. Thus, the economic situation of the Shakirovs worsened. On behalf of the parents of the deceased, the Mother's Right Foundation applied to court demanding to recalculate their monthly payments. The interests of the parents of the deceased were represented by the Mother's Right Foundation lawyer, Anna Mukaseyeva. The trial was won: the court recognized the parents' right to monthly payments equal to payments of war veterans, and obliged the defendant to grant the Shakirovs their MPs in this amount.
51) On April 23, the Moscow Region Court considered the cassation appeal against the decision of March 5, 2009 passed by the Elektrostal Town Court in favour of the parents of a dead serviceman, Lubov Petrovna and Sergey Nikolaevich Barushnikov. Their son, Andrey Baryshnikov, died on January 1, 1996 (see p. 28). The interests of the Baryshnikovs were represented by the Mother's Right Foundation lawyer, Anna Mukaseyeva. The trial was won: the court recognized the parents' right to measures of social support and monthly payments, and obliged the defendant to grant the Baryshnikovs these measures.
52) On April 23, the Zyuzinsky District Court considered the lawsuit filed by the Mother's Right Foundation on behalf of the mother of a dead serviceman, Natalia Fedorovna Firsova. Her son, Sergei Firsov ( b. 1971), Assistant Commander of Reconnaissance Company 165, Naval Infantry, POF, died in Chechnya on February 7, 1995, while in service (see p.p. 88, 102). The reconnaissance company under Sergey's command got into an ambush and he ordered his men to retreat. He stayed to cover their retreat. Because of the heavy fire, only one boy escaped alive. On the same day, the servicemen's bodies were liberated. No one had bullets; all of them were killed with control shots on the head. They found 72 wounds on Sergey's body... On May 3, 1995, he was awarded posthumously the title of Hero of the Russian Federation. As the mother of the Hero of the Russian Federation, Natalia Fedorovna had the right to an increased (100%) loss-of-breadwinner pension. But the Military Commissariat of the Moscow Region denied the mother of the deceased an increased pension. The Mother's Right Foundation applied to court. The interests of the mother of the deceased were represented by the Mother's Right Foundation lawyer, Anna Mukaseyeva.
53). On April 27, The Balashikha Town Court considered the application for establishment of a legal fact filed by the Mother's Right Foundation on behalf of the father of a dead serviceman, Ivan Gavrilovich Timoshenko. His son, Boris Timoshenko (b. 1962) was called up to military service on May 13, 1981, and served in M.U. 93261 (see p.p. 82, 89). On April 22, 1982, he died of electric shock. In the order excluding Boris Timoshenko from the list of the personnel, the commander did not mention that the soldier had died in military service which hindered the father of the deceased from receiving measures of social support. The father of the deceased applied to different archives for a detailed information on his son's death but found nothing. On behalf of the father of the deceased, the Mother's Right Foundation applied to court to prove that Boris Timoshenko's death was related to his military service. The interests of the father of the deceased were represented by the Mother's Right Foundation lawyer, Anna Mukaseyeva. The trial was won: the court recognized the fact that Boris Timoshenko had died in military service.
54) On April 28, the Moscow City Court considered the cassation appeal filed by the Moscow Military Commissariat against the decision of January 26 issued by the Chertanovsky District Court in favour of Valentina Petrovna Shustova, the mother of a dead serviceman, Evgeny Shustov (see p. 17). The Mother's Right Foundation applied to the Chertanovsky District Court, which on March 11, 2008 satisfied the claim of the mother of the deceased. On September 18, 2008, the decision was cancelled by the Moscow City Court; on January 26, 2009 it was reconsidered in the court of first instance. The court again passed the decision in favour of the mother of the deceased. The interests of the mother of the deceased were represented by the Mother's Right Foundation lawyer, Zarema Yusupova. The trial was won: the decision of the court of first instance was left in force, and must be executed.
55) On May 5 and 19, the Moscow City Court considered the cassation appeal filed by Pension Department 7, Moscow, against the decision of February 24, 2009 passed by the Perovsky District Court, Moscow, in favour of Valentina Alexeyevna and Anatoly Andreyevich Dergunov, the parents of the dead serviceman, Andrei Dergunov (see p. 26). The case was won in the court of first instance on February 24 but the Pension Department filed a cassation appeal. The interests of the parents of the deceased were represented by the Mother's Right Foundation lawyer, Zarema Yusupova. The trial was won: the decision of the court of first instance was left in force; the defendant's cassation appeal was denied.
56) On May 7, the Sudogodsky District Court, Vladimir Region, considered the lawsuit filed by the father of a dead serviceman, Vladimir Vasilievich Krutyh (see p. 69). His son, Ilyah Krutyh (b. 1988), was called up to military service on December 20, 2007, and served in M.U. 92889, Moscow, Headquarters Service Company. On June 24, 2008, Ilyah died in an accident (electric shock). His death was related to his military service. As a father of a soldier who died in military service, Vladimir Vasilievich had the right to measures of social support, but the Social Department of the Sudogodsky District, Vladimir Region, denied the father of the deceased a certificate confirming his right to these measures. The Mother's Right Foundation applied to court. The interests of the father of the deceased were represented by the Mother's Right Foundation lawyer, Zarema Yusupova. The trial was won: the court recognized the denial of the Social Department as illegal, and obliged it to give a certificate to the father of the deceased.
57) On May 8, the Roshal Town Court, Moscow Region, considered the lawsuit filed by the Mother's Right Foundation on behalf of the parents of a dead serviceman, Elena Vladimirovna and Andrei Vyacheslavovich Zhuravlev. Their son, Alexander Zhuravlev (b. 1984), was called up to military service on June 28, 2004, and served in M.U. 3275. On June 11, 2005, he died in military service. According to the law, his parents had the right to measures of social support. The Social Department of Roshal Town gave them the corresponding benefit certificates. But on January 1, 2009, they stopped rendering these services to the Zhuravlevs. On behalf of the parents of the deceased, the Mother's Right Foundation wrote a letter of claim to the Roshal Social Department. The interests of the parents of the deceased were represented by the Mother's Right Foundation lawyer, Anna Mukaseyeva. The trial was won: the court recognized the denial of the Roshal Social Department as illegal, and obliged the defendant to grant the Zhuravlevs these measures.
58) On May 14, the Simonovsky District Court, Moscow, considered the lawsuit filed by the Mother's Right Foundation on behalf of the parents of a dead serviceman, Zinaida Terentievna and Anatoly Ivanovich Ivanov (see p. 101). Their son, Oleg Ivanov (b. 1972), served in the army and died in military service. Since December 1991, his parents had been receiving the benefits equal to those of WWT veterans. After January 1, 2005 when FL 122 (monetization law) came into force, the parents started receiving measures of social support, including monthly payments. They were granted 150 roubles, while war veterans were granted 1050 roubles. Thus, the parents' economic situation worsened. On behalf of the Ivanovs, the Mother's Right Foundation applied to court demanding to recalculate the Ivanovs' monthly payments. The interests of the parents of the deceased were represented by the Mother's Right Foundation lawyer, Anna Mukaseyeva. The trial was won: the court recognized the parents' right to monthly payments equal to those of war veterans, and obliged the defendant to grant these payments in adequate amount.
59) On May 14, the Moscow City Court considered the cassation appeal filed by the Mother's Right Foundation on behalf of Ludmila Mikhailovna Kopylova, the mother of the dead serviceman, Boris Kopylov (see p. 9). Ludmila Mikhailovna applied to Pension Department 3 with the request to recalculate her monthly payments and pay the last year's debt. On behalf of the mother of the deceased, the Mother's Right Foundation applied to court. On January 30, 2009, the Cheremushkinsky District Court considered the case and passed the decision obliging the defendant to recalculate the mother's monthly payments from the date of her application, i.e. October 16, 2008. We thought that they should have recalculated the parents' payments from January 1, 2005 and appealed against the decision. The interests of the mother of the deceased were represented by the Mother's Right Foundation lawyer, Zarema Yusupova.
60) On May 15, the Kiznersky District Court, Rep. of Udmurtia, reconsidered the case of the denial of monthly payments to Valentina Petrovna and Vyacheslav Nikolaevich Yermakov, the parents of the dead soldier, Mikhail Yermakov (see p.p. 21, 77). After the Foundation's victory in the Supreme Court, the case was returned for retrial to the Kiznersky District Court, Udmurtia. The interests of the parents of the deceased were represented by the Mother's Right Foundation lawyer, Zarema Yusupoiva. The trial was won: according to the decision, the defendant was obliged to grant MPs to the Yermakovs, as well as the debt.
61) On May 18 and June 5, the Domodedovsky District Court considered the lawsuit filed by the Mother's Right Foundation on behalf of the mother of a dead serviceman from Orenburg, Rimma Valentinovna Kazakova (see p. 92). Her son, Sergey Zakharov (b. 1988), served as a sergeant in M.U. 41600, Moscow Region. He died on December 29, 2007. At first, the parents were told that their son had died of acute heart failure. Then, it was found out that the boy died of a cardiac arrest when punched by the captain of the same unit, Melnikov. The interests of the family of the deceased were represented by the Mother's Right Foundation: Melnikov was sentenced to 5 years of imprisonment. The Mother's Right Foundation demanded that M.U. 41600 pay the mother of the deceased compensation for moral damage caused by her son's death. The interests of the mother of the deceased were represented by the Mother's Right Foundation lawyer, Tatiana Sladkova. The trial was won: the court decision obliged M.U. 41600 to pay the mother of the deceased 700,000 roubles as compensation for moral damage for her son's death.
62) On May 27, the 3 Military District Court considered the cassation appeal filed by the Mother's Right Foundation against the decision passed by the judge of the 101 Garrison Court, Rushan Melisovich Rachapov (Orenburg) which denied the claim of Nabilya Mustafeyevna Galeyeva, mother of the dead serviceman, Denis Galeyev (see p.p. 34, 43, 111, 131) from the Chelyabinsk Region. The Mother's Right Foundation sent an appeal to the 101 Garrison Court against the decision to close the case, but judge Rachapov denied it. The Mother's Right Foundation filed a cassation appeal against Rachapov's denial. The interests of the mother of the deceased were represented by the Mother's Right Foundation lawyer, Zarema Yusupova. The trial was won: the panel of judges cancelled the decision passed by judge Rachapov and returned the case for retrial.
63) On May 29, the Industrialny District Court, Perm, considered the lawsuit filed by the Mother's Right Foundation on behalf of the father of a dead serviceman, Ramzei Salikhovich Sharipov. His son, Dmitry Salikhov (b. 1968), served in the soviet army, M.U. 83384, Tashkent. He died on February 23, 1989. Military officials told the family that he had died of acute heart failure, and his death was related to his military service. After their son's death, the family received the benefits for dead servicemen's families authorized in Article 7 of the USSR Law No. 313-1, August 1, 1989. According to this article, the benefits of dead servicemen's families were equal to those of WWT veterans. The monetization law, FL 122, replaced the in-kind benefits by measures of social support, which included monthly payments. According to Article 23.1 of the FL "On Veterans", the father of the deceased was granted 150 roubles while war veterans were granted 1050 roubles. Thus, the economic situation of the father of the deceased worsened. The father of the deceased applied to the Pension Department for recalculation of his monthly payments but his application was denied. On behalf of the father of the deceased, the Mother's Right Foundation applied to court. The interests of the father of the deceased were represented by the Mother's Right Foundation lawyer, Anna Mukaseyeva. The trial was won: the court recognized the father's right to recalculation of his MPs, and obliged the defendant to recalculate the payments and the debt.
64) On June 2, the Leninsky District Court, Penza, considered the lawsuit filed by the Mother's Right Foundation on behalf of the parents of a dead serviceman, Natalia Mikhailovna and Alexander Pavlovich Ilyin. Their son, Konstantin Ilyin (b. 1983), was called up to military service on May 16, 2004, and served in M.U. 42690. On August 28, 2004, he died, and his death was related to his military service. According to Article 21, s. 3, of the FL "On Veterans", his parents had the right to measures of social support, but the Health and Social Department of the Penza Region refused to give them corresponding certificates. To restore the justice, the Mother's Right Foundation applied to court. The interests of the parents of the deceased were represented by the Mother's Right Foundation lawyer, Zarema Yusupova. The trial was won: the defendant's denial was recognized as illegal; the court obliged the defendant to give the Ilyins their certificates.
65) On June 2, the Pyatigorsk Garrison Court considered the case of the death of Alexander Emelianov from the Volgograd Region. He was called up to military service on November 26. 2005, and served in M.U. 64201, Kabardino-Balkaria where he signed a contract. On November 11, 2008, he died in the resuscitation room of the Prokhladny Town hospital. He died of a shot wound to the head which he received on November 10. The charge under Article 249, s. 2 (careless use of a weapon which resulted in death) was brought against his fellow serviceman, Alexander Gennadievich Zherekhov. The latter was drunk and shoot at Alexander Emelianov's head. The interests of the mother of the deceased, Tatiana Khamrievna Tratsevskaya, were represented by the Mother's Right Foundation lawyer, Julia Lebedeva. The trial was completed: Zherekhov was sentenced to 3 years in a penal colony.
66) On June 3, the Samara Region Court considered the particular complaint against the decision of the Neftegorsky District Court, Samara Region, filed by the Mother's Right Foundation on behalf of the parents of a dead serviceman, Khanimziya Sundetovna and Albek Khabdrakhmanovich Kuanyshev. Their son, Bulat Kuanyshev (b. 1989), was called up to military service on June 2, 2008, and served in M.U. 41058, Samara Region. On June 22, 2008, he died of pneumonia. His death was related to his military service. According to Article 21 of the FL "On Veterans", his parents had the right to measures of social support but the Social Department of the Neftegorsky District, Samara Region, refused to give them their certificates confirming their right to these measures. At first, the parents of the deceased participated in the court trial on their own and did not receive the decision passed by the Neftegorsky District Court on April 8, 2009 in time. That's why they had no chance to appeal against the decision in time. The Kuanyshevs received the decision on April 24, 2009 and filed a cassation appeal only after that date. They also sent their application for restoring the cassation deadline. But the decision passed by the Neftegorsky District Court denied the parents' application (they went through this instance on their own). The Mother's Right Foundation filed a particular complaint against the decision. The interests of the parents of the deceased were represented by the Mother's Right Foundation lawyer, Anna Mukaseyeva.
67) On June 8, 18, 30, July 9, and August 14, 20, 21, the Pyatigosk Garrison Court considered the case of the death of Alexander Khmylnin (see p.p. 3, 103, 127). The investigation report signed by the deputy commander, Avdeyev, shocked the mother of the deceased: the military officials stated that Sasha allegedly "had committed suicide" because of his life problems. Elena Valentinovna Khmylnina did not believe that nonsense. Then appeared a new version: in the night from 21 to 22 January, 2007, two sergeants of M.U. 29483, Pavel Zhilov and Roman Prokhorov, used violence against four servicemen, Khmylnin among them. They were charged with hazing. The interests of the mother of the deceased were represented by the Mother's Right Foundation lawyers, Julia Lebedeva, Zarema Yusupova, and Tatiana Sladkova. The trial was completed: Prokhorov was sentenced to 6 months of imprisonment; Zhilov was sentenced to 2 years and 6 months of imprisonment.
69) On June 18, the Supreme Court of the Republic of Bashkortostan (Ufa) considered the particular complaint filed by the Mother's Right Foundation on behalf of Railya Gilmukhanovna and Alik Dautovich Mratov, the parents of the dead serviceman, Aidar Mratov (see p.p. 37, 96, 124), against the decision passed by the judge of the Leninsky District Court, Ufa City, R.A Mukhamediarova, on April 6, 2009. Under her decision, the parents' claim against the Pension Department which had denied the Mratovs' application for monthly payments was not accepted for processing. The Mother's Right Foundation filed a particular complaint against this decision. The interests of the parents of the deceased were represented by the Mother's Right Foundation lawyer, Anna Mukaseyeva. The trial was won: the decision passed by judge R.A Mukhamediarova on April 6, 2009 was recognized as illegal and cancelled.
69) On June 18, the Vladimir Region Court considered the defendant's cassation appeal against the positive decision of May 7, 2009 passed by the Sudogodsky District Court in favour of the father of a dead serviceman, Vladimir Vasilievich Krutyh. His son was Ilyah Krutyh (see p. 56). On May 7, 2009, the Mother's Right Foundation won the case of the Krutyhs in the court of first instance but the defendant filed a cassation appeal. The interests of the father of the deceased were represented by the Mother's Right Foundation lawyer, Zarema Yusupova.
70) On June 19, and July 7-8, the Frunzensky District Court, Vladimir, considered the lawsuit filed by the Mother's Right Foundation on behalf of Galina Alexandrovna Krutyh, the mother of the dead serviceman, Ilyah Krutyh (see p. 97). According to the law, the mother of the deceased had the right to a loss-of-breadwinner pension as the second pension but the Pension Department of Vladimir denied her application. On behalf of the mother of the deceased, the Mother's Right Foundation applied to court. The interests of the mother of the deceased were represented by the Mother's Right Foundation lawyer, Zarema Yusupova. The trial was won: the court recognized the mother's right to two pensions and obliged the defendant to grant her a loss-of-breadwinner pension.
71) On June 22, the Samara Region Court considered the cassation appeal filed by the Pension Department of the Promyshlenny District, Samara, against the decision of May 21, 2009 passed by the Sovetsky District Court, Samara, in favour of Sofia Tagirovna and Ryauf Valievich Shakirov, the parents of the dead serviceman, Marat Shakirov (see p. 50). On behalf of the parents of the deceased, the Mother's Right Foundation filed a lawsuit and on May 21, 2009 won the case, but the defendant filed a cassation appeal. The trial was won: the positive decision of the court of first instance was left in force.
72) On June 24, the Tyumen Region Court considered the extraordinary appeal filed by the Mother's Right Foundation on behalf of Maria Dmitrievna Potanina, the mother of the dead serviceman, Sergey Potanin. On behalf of the mother of the deceased, the Mother's Right Foundation filed a lawsuit in the Uporovsky District Court. On June 2, the case was considered. The court denied the mother's claim (see p. 23). We filed a cassation appeal against the decision of August 6, 2008; the cassation instance satisfied our cassation appeal and returned the case for retrial. But the Uporovsky District Court denied the mother's claim for the second time and on February 9, 2009 the cassation instance agreed with this decision. The Mother's Right Foundation sent an extraordinary appeal to the Presidium of the Tyumen Region Court. The trial was won: the supervisory instance cancelled all previous decisions and passed its own decision recognizing the mother's right to receive the debt for the 12 months preceding the date of her application for a loss-of-breadwinner pension.
73) On June 24, the Simonovsky District Court, Moscow, considered the lawsuit filed by the Mother's Right Foundation on behalf of the mother of a dead serviceman, Raisa Timofeyevna Krokhina. Her son, Sergei Vankov (1961), was called up to military service in November 1980, and served in M.U. 3472. On June 29, 1981 he died, and his death was related to his military service (see p. 119). Since 1993, the mother of the deceased had been receiving the benefits equal to those of WWT veterans according to Article 7 of the USSR Law "Urgent Measures on Improvement of Pension and Social Insurance", No. 313-1, August 1989. On January 1, 2005, Federal Law 122 ("monetization law") came into force, and Raisa Timofeyevna started receiving the measures of social support which included monthly payments. As the mother of the deceased was a disabled person (group 2) and had the right to MPs for two reasons - as a dead serviceman's family member and as a disabled person - she had a choice. She chose to be granted a disability pension. War veterans were granted a monthly payment in the amount of 1050 roubles which was higher than the amount of monthly payments of parents of dead servicemen and those of disability pensions. Thus, the ‘monetization law' worsened the economic situation of the mother of the deceased. Krokhina applied to the Pension Department for the recalculation of her monthly payments but her application was denied. On behalf of the mother of the deceased, the Mother's Right Foundation applied to court. The interests of the mother of the deceased were represented by the Mother's Right Foundation lawyer, Zarema Yusupova. The trial was won: the court obliged the defendant to recalculate the mother's monthly payments.
74) On June 26, the Volgograd Region Court considered the particular complaint filed by the Mother's Right Foundation against the decision of April 3, 2009 passed by the Kamyshin Town Court, Volgograd Region. The decision denied consideration of the claim of Alexander Nikolaevich Pchelintsev, the father of the dead serviceman, Dmitry Pchelintsev. We filed a particular complaint against the decision. The interests of the father of the deceased were represented by the Mother's Right Foundation lawyer, Anna Mukaseyeva. The trial was won: the decision of April 3, 2009 passed by the Kamyshin Town Court was cancelled; the case was returned to the court of first instance for retrial.
75) On June 2, the Podgorensky District Court, Voronezh Region, considered the lawsuit filed by the Mother's Right Foundation on behalf of the mother of a dead serviceman, Elena Viktorovna Kulkina. Her son, Sergei Kulkin (b. 1973) was called up to military service on December 10, 1991, and served in M.U. 2397. On July 3, 1992 he died of acute heart failure, and his death was related to his military service (see p.p. 76, 99, 115). While preparing for the court hearing on her right to monthly payments equal to those of war veterans, Elena Viktorovna bumped into a problem: the notary of the Notary Department of the Podgorensky District, Voronezh Region, Klavdia Vasilievna Laktionova, refused to mention all lawyers of the Mother's Right Foundation in one letter of attorney. The notary wanted to get the pay for six letters... The Mother's Right Foundation had to file one more claim - against the actions of the notary. The interests of the mother of the deceased were represented by the Mother's Right Foundation. The trial was won: the court recognized K.V. Laktionova's refusal as illegal, and obliged the notary to draw up a letter of attorney to all six lawyers of the Mother's Right Foundation.
76) On July 2 and 10, the Podgorensky District Court, Voronezh Region, considered the lawsuit filed by the Mother's Right Foundation on behalf of the mother of a dead serviceman, Elena Viktorovna Kulkina (see p.p. 75, 99, 115). After her son's death, the mother received the benefits equal to those of WWT veterans authorized in Article 7 of the USSR Law "Urgent Measures on Improvement of Pension and Social Insurance", No. 313-1, August 1989. When Federal Law 122 ("monetization law") came into force, the in-kind benefits were replaced by measures of social support, including monthly payments. On behalf of Kulkina, the Mother's Right Foundation applied to court. The interests of the mother of the deceased were represented by the Mother's Right Foundation lawyer, Anna Mukaseyeva.
77) On July 6, the board of judges of the Supreme Court of Udmurtia (Izhevsk) considered the cassation appeal filed by the defendant against the decision of May 15, 2009 passed by the Kiznersky District Court in favour of Valentina Petrovna and Vyacheslav Nikolaevich Yermakov, parents of the dead serviceman, Mikhail Yermakov (see p.p. 21, 60). His death was related to his military service, so his parents had the right to measures of social support authorized in Article 21, s. 3, of the law "On Veterans". Representatives of the Pension Department could not stand the fact that we had won the case of the Yermakovs in the RF Supreme Court and in the Kiznersky District Court (May 15) and filed a cassation appeal. The interests of the mother of the deceased were represented by the Mother's Right Foundation lawyer, Zarema Yusupova. The trial was won: the board of judges left in force the decision passed by the court of first instance on May 15, 2009.
78) On June 15, the Barnaul Garrison Court (Altai Region) satisfied the application concerning the jurisdiction of the case of the death of Anton Dolin filed by the Mother's Right Foundation on behalf of the parents of a dead serviceman from the Perm Region, Galina Ivanovna and Ivan Sergeyevich Dolin (see p.p. 93, 113). Anton Dolin (b. 1986), was called up to military service on June 6, 2006. He served in M.U. 3179, Vityaz Detachment, Dzerzhinsky Division, Special Forces, Reutov Town, Moscow Region. On November 18, he was severely beaten by the contract sergeant and his fellow serviceman, Roman Cherepanov. In a month, Anton died in the Burdenko hospital. The unit officers ‘lost sight' of Cherepanov. He escaped to the Altai Region where he lived for two years. In autumn 2008, he was detained by a militia patrol in his home village. He was charged under the RF CC: Article 111, s. 4; Article 286, s. 3, p.p. "a" and "c"; Article 338, s. 1. The Mother's Right Foundation filed an application for sending the case to the Reutov Garrison Court, according to its jurisdiction. The interests of the parents of the deceased were represented by the Mother's Right Foundation lawyer, Julia Lebedeva. The trial was won: according to the court decision, the case was sent to the Reutov Garrison Court.
79) On July 15, 29, the Dmitrovgrad Town Court, Ulyanovsk Region, considered the lawsuit filed by the Mother's Right Foundation on behalf of the mother of a dead serviceman, Galina Nikolayevna Timofeyeva. Her son, Nikolay Timofeyev (b. 1976), was called up to military service on June 30, 1995, and served in M.U. 54058 (see p. 95). On June 1, 1995, he died in military service in Chechnya. According to Article 7 of the USSR Law "Urgent Measures on Improvement of Pension and Social Insurance", No. 313-1, August 1989, the parents of the deceased had the right to the benefits equal to those of WWT veterans. The Federal Law "On Veterans", January 16, 1995 authorized some other benefits for parents of dead servicemen. They were equal to those of war invalids, WWT veterans and other war veterans, and the mother of the deceased received the benefits equal to those of WWT veterans. When Federal Law 122 (monetization law) came into force, the mother of the deceased was granted a monthly payment which was not equal to a monthly payment of a WWT veteran. The mother of the deceased applied to the local Pension Department for recalculation of her MPs but her application was denied. The Mother's Right Foundation filed a claim on behalf of Galina Nikolayevna.
80) On July 21, the Samara Military District Court considered the cassation appeal against the decision of June 1, 2009 filed in the case of Roman Semenov from Penza who died in a reservist camp (see p.p. 49, 84). The decision sentenced the doctor Alexander Nikolayevich Ivanov to two years of probation under Article 293, s. 2. The widow was not satisfied with the mild sentence for the man who was guilty for her being left alone with two children. The Mother's Right Foundation filed a cassation appeal against the decision of the court of first instance. The interests of the mother of the deceased were represented by the Mother's Right Foundation lawyer, Julia Lebedeva.
81) On July 23, the Moscow City Court considered the cassation appeal filed by the Moscow Military Commissariat against the decision of February 18, 2009 passed by the Meschansky District Court in favour of the son of a dead serviceman, Igor Igorevich Tribuntsov. His father, Igor Tribuntsov, served as a colonel in M.U. 52715 (see p. 24). The Mother's Right Foundation won the case in the court of first instance but the Commissariat filed a cassation appeal. The interests of the son of the deceased were represented by the Mother's Right Foundation lawyer, Zarema Yusupova. The trial was won: the decision of February 18, 2009 passed by the Meschansky District Court was left in force.
82) On July 27-28, the Balashikha Town Court considered the lawsuit filed by the Mother's Right Foundation on behalf of the father of a dead serviceman, Ivan Gavrilovich Timoshenko. His son, Boris Timoshenko (b. 1962), was called up to military service on May 13, 1981, and served in M.U. 93261 (see p.p. 53, 89). On April 22, 1982, he died of electric shock. On June 1, 1991, the MIA granted Ivan Gavrilovich a service pension; on June 1, 2006, he was granted a loss-of-breadwinner pension. But in two years, on July 1, 2008, the Pension Department of Moscow and the Moscow Region stopped paying his loss-of-breadwinner pension. Obviously, the department officials thought that two pensions were too much for the father of the deceased. The interests of the father of the deceased were represented by the Mother's Right Foundation lawyer, Anna Mukaseyeva. The trial was won: the court recognized the father's right to two pensions and obliged the Pension Department to resume paying his loss-of-breadwinner pension.
83) On July 31, the Leninsky District Court, Yekaterinburg, considered the lawsuit filed by the Mother's Right Foundation on behalf of the mother of a dead serviceman, Galina Viktorovna Titova. Her son, Nikolay Titov (b. 1986), was called up to military service on November 22, 2004, and served in M.U. 32477, Volgograd Region (see p.p. 45, 105). During his service, he signed a contract. On March 22, 2006, he died in military service. His mother, Galina Viktorovna had been a disabled person since 2002. She had no other income beside a disability pension. According to the law, as a mother of a contract serviceman who died in military service she had the right to a loss-of-breadwinner pension as the second pension. In December 2007, the mother of the deceased applied to the Military Commissariat of the Sverdlov Region for a loss-of-breadwinner pension but her application was denied. On behalf of Galina Viktorovna, the Mother's Right Foundation wrote a letter of claim. The interests of the mother of the deceased were represented by the Mother's Right Foundation lawyer, Zarema Yusupova. The trial was won: the court obliged the defendant to grant the mother of the deceased a loss-of-breadwinner pension from December 12, 2006, i.e. for the 12 months preceding the date of application.
84) On August 4, the Oktyabrsky District Court, Penza, considered the lawsuit filed by the Mother's Right Foundation on behalf of the widow of Roman Semenov from Penza (see p.p. 49, 80), Svetlana Nikolayevna Semenova (in the interests of her underage twins, Maxim and Katya (b. 1995). The Pension Department denied the widow of the deceased a normal pension. The underage children were granted understated loss-of-breadwinner pensions - 1950 roubles instead of 3900 roubles for each child. On behalf of the Semenovs, the Mother's Right Foundation applied to court. The interests of the Semenovs were represented by the Mother's Right Foundation lawyer, Anna Mukaseyeva. The trial was won: the court recognized the children's right to adequate loss-of-breadwinner pensions, and obliged the defendant to grant these pensions from February 8, 2009, i.e. the date of application.
85) On August 4, the Krasnodar Region Court considered the cassation appeal filed by the Mother's Right Foundation on behalf of the parents of a dead serviceman, Tamara Grigorievna and Vasily Grigorievich Zhuravlev. Their son, Vitaly Zhuravlev (b. 1979), served as a contract captain in M.U. 20004 (see p. 33). The Military Commissariat of the Krasnoarmeisky District, Krasnodar Region, denied the parents of the deceased the right to measures of social support. On behalf of the parents of the deceased, the Mother's Right Foundation applied to court but the Krasnoarmeisky District Court, Krasnodar Region, denied the Zhuravlev's application. The Mother's Right Foundation filed a cassation appeal. The interests of the parents of the deceased were represented by the Mother's Right Foundation lawyer, Zarema Yusupova.
86) On August 5, September 16, October 13, November 12, and December 2, the Promyshlenny District Court, Smolensk, considered the lawsuit filed by the Mother's Right Foundation on behalf of the mother of a dead serviceman, Natalia Alexandrovna Dudina. Her son, Dmitry Dudin (b. 1989), was a contract serviceman in M.U. 73881. On November 19, 2008, he died in a car accident, and his death was related to military service. According to Article 21, s. 3, of the law "On Veterans", his mother had the right to measures of social support. But the Military Commissariat of the Smolensk Region denied the mother of the deceased these measures. On her behalf, the Mother's Right Foundation applied to court. The interests of the mother of the deceased were represented by the Mother's Right Foundation lawyer, Zarema Yusupova. The trial was won.
87) On August 7 and 13, the Serpukhov City Court, Moscow Region, considered the lawsuit filed by the Mother's Right Foundation on behalf of Lidia Georgievna Strebkova, the mother of the dead serviceman, Evgeny Sidorov (b. 1966). The lawsuit involved the Central Pension Department, No. 11, Moscow and the Moscow Region, and the third party - the Social Department of Serpukhov Town. Lidia Georgievna's son served in M.U. 25963; during his service, he fell ill and died on May 9, 1987. His death was related to his military service. Since July 5, 1993, Lidia Georgievna had been receiving the benefits equal to those of WWT veterans (according to Article 7 of the USSR Law "Urgent Measures on Improvement of Pension and Social Insurance", No. 313-1, August 1989). In 2005 when some in-kind benefits were replaced by monthly payments, Strebkova was granted a monthly payment which was lower than a war veteran's monthly payment. Her status was not taken into consideration. When she applied to the defendant for a monthly payment equal to a war veteran's monthly payment, the Pension Department informed her that they had stopped payments because her son had not ‘been killed' but ‘had died'. On behalf of Strebkova, the Mother's Right Foundation applied to court. The interests of the mother of the deceased were represented by the Mother's Right Foundation lawyer, Zarema Yusupova. The trial was won: the court recognized the mother's right to a monthly payment equal to that of a WWT veteran; considered the cessation of payments as illegal; obliged the defendant to recalculate Strebkova's MPs from January 1, 2005. The court made a particular decision on the Social Department of Serpukhov Town.
88) On August 27, the Moscow City Court considered the cassation appeal filed by the Mother's Right Foundation on behalf of the mother of a dead serviceman, Natalia Fedorovna Firsova. Her son, senior lieutenant Sergey Firsov (see p.p. 52, 102) died in military service in Chechnya on May 3, 1995. On May 3, 1995, he was awarded the title of Hero of the Russian Federation. The Military Commissariat of the Moscow Region refused to increase (100%) her loss-of-breadwinner pension which was due to her under the law. On behalf of the mother of the deceased, the Mother's Right Foundation applied to court but on April 23, 2009, the Zyuzinsky District Court, Moscow, illegally supported the position of the Commissariat officials. The Mother's Right Foundation filed a cassation appeal against the decision. The interests of the mother of the deceased were represented by the Mother's Right Foundation lawyer, Anna Mukaseyeva. The trial was won: the panel of judges cancelled the decision of the Zyuzinsky District Court, Moscow, and returned the case for retrial.
89) On August 27, the Moscow Region Court considered the cassation appeal against the decision of July 28, 2009 passed by the Balashikha Town Court in favour of the father of a dead serviceman, Ivan Gavrilovich Timoshenko (see p.p. 53, 82). The Pension Department did not accept the victory of the Mother's Right Foundation and filed a cassation appeal. The trial was won: the panel of judges left the decision of the Balashikha Town Court in force; the cassation appeal of the Pension Department was denied.
90) On September 2, the 3 Military District Court considered two cassation appeals. The first one was filed by the Mother's Right Foundation on behalf of the sister of a dead serviceman, Alsu Zyamilovna Minibayeva (victim in the case of the death of her brother). Her brother, Rustem Gainullin (b. 1987), was called up to military service from the Republic of Tatarstan in November 2007. He served in M.U. 39995. On August 29, he died. Rustem was found in a nooze in one of the unit's buildings. As was found out by the investigation, Rustem had been driven to suicide by the constant humiliation and beating on the part of his fellow servicemen, particularly senior servicemen F.V. Moiseyev. On May 20, 2009, the Cheremkhovsky Garrison Court (Irkuts) sentenced F.V. Moiseyev to 5 years of imprisonment under Article 335, s. 3, of the RF CC (bullying with grave consequences). The second cassation appeal was filed by the advocate of the convict: he demanded a milder sentence. The interests of the sister of the deceased were represented by the Mother's Right Foundation lawyer, Julia Lebedeva. The trial was completed: the court left the decision of the court of first instance in force.
91) On September 2, 17, the Livensky District Court, Orel Region, considered the lawsuit filed by the Mother's Right Foundation on behalf of the mother of a dead serviceman, Maria Ivanovna Avdeyeva (see p. 118). Her son, Ivan Avdeyev (b. 1988), was called up to military service on June 25, 2007, and served in M.U. 61616. On April 8, 2008, he died of an ailment in the army. After her son's death, on November 6, 2008, the mother of the deceased received a certificate confirming her right to measures of social support authorized for parents of fallen servicemen. But in February 2009, the mother of the deceased was summoned to the Social Department of the Livensky District, Orel Region: the officials took away her certificate. She was told that there had been a request from the Pension Department. On behalf of the mother of the deceased, the Mother's Right Foundation applied to court. The interests of the mother of the deceased were represented by the Mother's Right Foundation lawyer, Zarema Yusupova.
92) On September 3, the Moscow Region Court considered the cassation appeal filed by the RF Ministry of Finance against the decision of June 5, 2009 passed by the Domodedovo Town Court in favour of the mother of a dead serviceman, Rimma Valentinovna Zakharova (see p. 61). The decision satisfied the claim of the Mother's Right Foundation demanding that the mother of the deceased be paid 700,000 roubles as compensation for moral damage caused by her son's death. Representatives of the Ministry of Finance did not attend the hearing, when the decision was issued, but later filed a cassation appeal against the decision. The interests of the mother of the deceased were represented by the Mother's Right Foundation lawyer, Tatiana Sladkova. The trial was won: the board of judges changed the defendant - the Ministry of Finance was replaced by the Ministry of Defense; the amount of the compensation was left unchanged.
93) On September 4, the West-Siberian Military District Court considered the cassation appeal filed by the representative of the accused against the decision of June 15, 2009 passed by the Barnaul Garrison Court (Altai Region) in the case of the death of Anton Dolin (b. 1986) from the Perm Region (see p.p. 78, 113). The representative of Cherepanov did not accept the decision of the court of first instance which had satisfied the application of the Mother's Right Foundation. In the application, the Mother's Right Foundation requested that the case be sent from the Altai Region to Reutov, Moscow Region, according to the jurisdiction. The interests of the mother of the deceased were represented by the Mother's Right Foundation lawyer, Julia Lebedeva. The trial was won: the panel of judges left the decision of the Barnaul Garrison Court in force, and denied the cassation appeal of the advocate of the accused.
94) On September 8, the Kursk Region Court considered the cassation appeal filed by the Mother's Right Foundation on behalf of the mother of a dead serviceman, Svetlana Nikolaevna Bondareva (see p. 29). On May 21, the Timsky District Court, Kursk Region, satisfied the claim filed by the Mother's Right Foundation which demanded that the mother of the deceased be paid 100,000 roubles as compensation for moral damage caused by her son's death. The interests of the mother of the deceased were represented by the Mother's Right Foundation lawyer, Tatiana Sladkova. The trial was won: the panel of judges changed the decision of the court of first instance - the guilty unit 3792 was obliged to pay 500,000 roubles to the mother of the deceased as compensation for moral damage caused by her son's death.
95) On September 8, the Ulyanovsk Region Court considered the cassation appeal filed by the Mother's Right Foundation on behalf of Galina Nikolaevna Timofeyeva, mother of the dead serviceman, Nikolai Timofeyev (see p. 79). The Pension Department denied the mother of the deceased a monthly payment equal to that of a WWT veteran. On behalf of the mother of the deceased, the Mother's Right Foundation applied to court but the Dmitrograd Town Court, Ulyanovsk Region, denied the claim. We filed a cassation appeal against the decision. The interests of the mother of the deceased were represented by the Mother's Right Foundation lawyer, Zarema Yusupova.
96) On September 9 and 30, the Leninsky District Court, Ufa, considered the lawsuit filed by the Mother's Right Foundation on behalf of the parents of a dead serviceman, Railya Gilmukhanovna and Alik Dautovich Mratov. Their son, Aidar Mratov (b. 1988), served in M.U. 02014 (see p.p. 37, 68, 124). The local Pension Department denied the parents of the deceased monthly payments. On behalf of the Mratovs, the Mother's Right Foundation applied to court. The interests of the parents of the deceased were represented by the Mother's Right Foundation lawyer, Anna Mukaseyeva.
97) On September 10, the Vladimir Region Court considered the cassation appeal filed by the Vladimir Pension Department against the decision of July 8, 2009 passed by the Frunzensky District Court in favour of the mother of a dead serviceman, Galina Alexandrovna Krutyh (see p. 70). The Volgograd Pension Department denied the mother of the deceased a loss-of-breadwinner pension as the second pension (the mother received her service pension). On behalf of Galina Alexandrovna, the Mother's Right Foundation applied to court and won the case on July 8, 2009. But the Pension Department filed a cassation appeal. The interests of the mother of the deceased were represented by the Mother's Right Foundation lawyer, Zarema Yusupova. The trial was won: the decision of the court of first instance was left in force.
98) On September 11, 29, the Shakhun Town Court, Nizhny Novgorod Region, considered the lawsuit filed by the Mother's Right Foundation on behalf of the mother of a dead serviceman, Evgenia Nikolaevna Sokolova (see p. 129). Her son, Mikhail Zhuravlev (b. 1977), was called up to military service on June 4, 1995, and served in M.U. 29483. On September 11, 1996, he died in military service. According to the law, his mother had the right to a loss-of-breadwinner pension but the local Pension Department denied Evgenia Nikolayevna's application. On behalf of the mother of the deceased, the Mother's Right Foundation applied to court. The interests of the mother of the deceased were represented by the Mother's Right Foundation lawyer, Anna Mukaseyeva.
99) On September 15, the Voronezh Region Court considered the cassation appeal filed by the Mother's Right Foundation on behalf of the mother of a dead serviceman, Elena Viktorovna Kulkina (see p.p. 75, 76, 115). The Pension Department refused to recalculate the mother's monthly payments making them equal to those of WWT veterans. On behalf of the mother of the deceased, the Mother's Right Foundation applied to court but on July 10, 2009 the Podgorensky District Court, Voronezh Region, denied Kulkina's claim. The Mother's Right Foundation filed a cassation appeal. The interests of the mother of the deceased were represented by the Mother's Right Foundation lawyer, Anna Mukaseyeva.
100) On September 16, 30, October 5, 12, and 20, the Vladivostok Garrison Court re-considered the case of the death of Mikhail Metelev (b. 1984) from Kirov (see p. 12). He served as a contract warrant officer class 2 and torpedo artificer in M.U. 73091, submarine B-345. On February 21, 2008, he died while busy with dangerous work on torpedo apparatuses. The charge was brought against the assistant commander of M.U. 73031, captain of 3 rank, Andrei Viktorovich Koleda, and commander of M.U. 73031, captain-lieutenant Alexander Alexandrovich Krasnov under Article 286, s. 3, p. "c" of the RF CC (exceeding official authority with grave consequences). Mikhail Metelev was an orphan. His sister, Ludmila Kleptsova, was his closest relative. Her interests were represented by the Mother's Right Foundation lawyer, Julia Lebedeva. The trial was completed: Koleda was sentenced to 3 years in a colony and deprived of the right to take up an official post connected with leadership. Krasnov was justified (we filed a cassation appeal against Krasnov's sentence and won the case - see the 2010 Report, first six months).
101) On September 17, the Moscow City Court considered the cassation appeal filed by Pension Department No. 4, Moscow and the Moscow Region, against the decision of May 14, 2009 passed by the Simonovsky District Court, Moscow, in favour of the parents of a dead serviceman, Zinaida Terentievna and Anatoly Ivanovich Ivanov. Their son was Oleg Ivanov (see p. 58). The Pension Department refused to make the parents' monthly payments equal to those of WWT veterans. On behalf of the Ivanovs, the Mother's Right Foundation applied to court and won the case on May 14, 2009 but the Pension Department filed a cassation appeal. The interests of the parents of the deceased were represented by the Mother's Right Foundation lawyer, Zarema Yusupova. The trial was won: the panel of judges left the decision of the court of first instance in force; the cassation appeal of the Pension Department was denied.
102) On September 18, 24, and 28, the Zyuzinsky District Court, Moscow, re-considered the lawsuit filed by the Mother's Right Foundation on behalf of the mother of a dead serviceman, Natalia Fedorovna Firsova (see p.p. 52, 88). On behalf of Natalia Fedorovna, the Mother's Right Foundation filed a lawsuit against the Military Commissariat of the Moscow Region, which denied the mother of the deceased to increase (100%) her loss-of-breadwinner pension. She should have received an increased pension according to the law because the deceased had been awarded the title of Hero of the Russian Federation. On April 23, 2009, the Zyuzinsky District Court denied Firsova's claim. The Mother's Right Foundation filed a cassation appeal and won the case in the court of second instance on August 27, 2007. The case was sent for retrial to the Zyuzinsky District Court, Moscow. The interests of the mother of the deceased were represented by the Mother's Right Foundation lawyer, Anna Mukaseyeva. The trial was won: the court obliged the defendant to grant the mother of the deceased an increased loss-of-breadwinner pension and pay her the debt from 1999 (some 200,000 roubles).
103) On September 22, the Pyatigorsk Military District Court considered the application for restoration of the cassation deadline filed by the Mother's Right Foundation on behalf of the mother of a dead serviceman, Elena Valentinovna Khmylnina. Her son, Alexander Khmylnin (b. 1986), was called up to military service on December 21, 2004; after the training camp he signed a contract and served as cook in M.U. 29483. On January 22, 2007, he died (see p.p. 3, 67, 127). The mother of the deceased was not satisfied by the convict's mild sentence. On her behalf, the Mother's Right Foundation filed a cassation appeal. Due to the delayed reception of the court decision, Elena Valentinovna was not able to file a cassation appeal in time. We filed a petition for restoring the cassation deadline. The interests of the mother of the deceased were represented by the Mother's Right Foundation lawyer, Tatiana Sladkova. The trial was won. The cassation deadline was restored.
104) On September 25 and October 22, the Leninsky District Court, Rostov-on-Don, considered the application for indexing the compensation filed by the Mother's Right Foundation on behalf of the mother of a dead serviceman, Galina Alexandrovna Mineyeva. Her son, Ruslan Mineyev (b. 1983), was called up to military service from the Orenburg Region, and served in M.U. 96722 (Samara). He died in M.U. 23132 on the territory of the Republic of Chechnya on March 25, 2004. He died due to the actions of the chief of the engineering service of M.U. 23132, major S.N. Kudryavtsev. The latter decided to settle 4 portable mine fields near the checkpoint of the two units - 23132 and 96722. As a result, Ruslan and other 10 servicemen from both units died; one serviceman was wounded... The Grozny City Court considered S.N. Kudryavtsev's actions as negligence (Article 293, s. 2 and 3) but he was not punished at all because he was granted amnesty. The Mother's Right Foundation demanded that the military unit pay compensation to the mother of the deceased and won the trial on September 20, 2007. After the cassation session of January 28, 2008, the decision came into force. It was executed only on May 7, 2009. The Mother's Right Foundation filed an application to index the compensation. The interests of the mother of the deceased were represented by the Mother's Right Foundation lawyer, Tatiana Sladkova. The trial was won: the court obliged the defendant to pay the mother of the deceased 80,360 roubles in addition to the already paid 500,000 roubles of the compensation.
105) On October 1, 29 and December 22, the Zamoskvoretsky District Court, Moscow, considered the lawsuit filed by the Mother's Right Foundation of behalf of the parents of a dead serviceman, Galina Viktorovna and Viktor Nikolayevich Titov. Their son, Nikolai Titov (b. 1986), was called up to military service on November 22, 2004, and served in M.U. 32477, Volgograd Region (see p.p. 45, 83). During his service, Nikolai Titov signed a contract. On March 22, 2006, he died in military service. His parents still have not received a pecuniary compensation authorized for families of servicemen who died in military service (120 serviceman's monthly payments). On behalf of the parents of the deceased, the Mother's Right Foundation applied to court. The defendant is Rosgosstrakh, the Russian state insurance company. The interests of the parents of the deceased were represented by the Mother's Right Foundation lawyer, Zarema Yusupova. The trial was won: the court obliged the defendant to pay a pecuniary compensation.
106) On October 6, the Krasnogvardeisky District Court, St. Petersburg, considered the application for restoring the cassation deadline filed by M.U. 43117 which had lost the trial and had been obliged to pay compensation to the aunt of a dead serviceman, Ludmila Vladimirovna Gromova. Her nephew was Denis Panasenko (see p. 36). At first, the representatives of the military unit did not file a cassation appeal, missed the deadline, and then filed an application for restoring the missed cassation deadline. The interests of the aunt of the deceased were represented by the Mother's Right Foundation lawyer, Tatiana Sladkova. The trial was won: the court passed the decision denying the appeal of M.U. 43117.
107) On October 14, the Rzhev Town Court considered the lawsuit filed by the Mother's Right Foundation on behalf of the mother of a dead serviceman, Nina Vasilievna Gurtovenko. Her son, Denis Gurtovenko (b. 1980), was a student of the Military Space Academy, Pushkin, Leningradsky Region. On January 7, 2003, he died. According to the death certificate, his death was related to his military service. His mother had the right to measures of social support but the Rzhev Pension Department, Tver Region, denied her application. On behalf of Gurtovenko, the Mother's Right Foundation applied to court. The trial was won: the court recognized Gurtovenko's right to measures of social support; the denial of the Pension Department was recognized as illegal; the defendant was obliged to grant the measures of social support to the mother of the deceased from April 8, 2009, i.e. the date of application.
108) On October 16, November 20, a JP of Court No. 99 of the Kuedinsky District Court, Perm Region, considered the lawsuit filed by the Mother's Right Foundation on behalf of the parents of a dead serviceman, Margarita Gennadievna and Nikolai Alexandrovich Terebov. Their son, Dmitry Terebov (b. 1979), served in M.U. 30672 (see p. 42). On November 14, 1998, he died in military service. His parents had the right to measures of social support under the Federal Law "On Veterans", No. 21. They had been enjoying these measures till March 1, 2006 but then the Pension Department of the Kuedinsky District stopped paying their monthly payments. The Mother's Right Foundation lawyers wrote the parents' letter of claim. The Kuedinsky District Court, Perm Region, passed the decision in their favour: the defendant was obliged to pay the Terebovs the debt MPs; the decision came into force on April 24, 2009. It was executed only on August 14, 2009. On behalf of the Terebovs, the Mother's Right Foundation wrote a letter of claim for indexing the debt. The trial was won: the court obliged the defendant to index the debt.
109) On October 20, 26 and November 24, the Oktyabrsky District Court, Orsk Town, considered the lawsuit filed by the Mother's Right Foundation on behalf of the mother of a dead serviceman, Elena Nikolayevna Karimova. Her son, Artur Karimov (1985), was called up to military service on June 2, 2004, and served in M.U. 42710, Rostov Region. After the training course, along with other servicemen he was transported to a new place of service by train, ‘Krasnodar-Vladivostok'. On the way there, Artur made a noose from his belt and hanged himself. The investigation found out that he had been driven to suicide by the actions of his fellow serviceman, Dmitry Glazkov. The Mother's Right Foundation represented the interests of the mother of the deceased in the trial; on November 5, 2008, Glazkov was pleaded guilty under Article 335, s. 3, of the RF CC (bullying with grave consequences) and was sentenced to 2,5 years of imprisonment. On behalf of Elena Nikolaevna, the Mother's Right Foundation filed a claim for compensation for moral damage. The interests of the mother of the deceased were represented by the Mother's Right Foundation lawyer, Tatiana Sladkova. The trial was won: military units 42710 and 26381 were obliged to pay jointly 700,000 roubles to the mother of the deceased as compensation for her son's death.
110) On October 22 and November 10, the Rasskazov Town Court, Tambov Region, considered the lawsuit filed by the Mother's Right Foundation on behalf of the parents of a dead serviceman, Nina Pavlovna and Sergei Anatolievich Bastrykin. Their son, Roman Bastrykin (b. 1983), was a student of the Tambov Military Aviation Engineering Institute. On June 1, 2002, he died of a cardiac arrest - he was punched on the chest by his fellow student, Nikolai Alexandrovich Sukhomlinov. On August 7, 2002, the Tambov Garrison Court sentenced Sukhomlinov to 5 years of imprisonment under Article 335, s. 3, of the RF CC (abuse of authority). The death of Roman Bastrykin was related to his military service. As parents of a dead serviceman, the Bastrykins received measures of social support.
On April 1, 2009, the local Pension Department denied the parents these measures and the Social Department of Rasskazovo Town, Tambov Region, took away their certificates. The officials explained that the parents had no right to enjoy these measures because their son ‘had not fallen' but ‘had died'. On behalf of the Bastrykins, the Mother's Right Foundation applied to court. The interests of the parents of the deceased were represented by the Mother's Right Foundation lawyer, Anna Mukaseyeva.
111) At the assizes of October 26, the 101 Garrison Court considered the complaint filed by the Mother's Right Foundation against the close of the trial of Denis Galeyev who died in the army. Denis was called up to military service from Chelyabinsk in December 2005, and served in M.U. 54203, Sverdlov Region (Strategic Missile Forces). On March 12, 2007, he died. The military officials told his mother that he ‘had committed suicide' but she did not believe their version. The interests of the mother of the deceased were represented by the Mother's Right Foundation lawyer, Zarema Yusupova (see p.p. 34, 43. 62, 131).
112) On October 26, the Maikop Town Court, Rep. of Adygeya, considered the lawsuit filed by the Mother's Right Foundation on behalf of the father of the deceased, Alexander Anatolievich Matrosov. His son , Anatoly Matrosov (b. 1978), was called up to military service on May 29, 1996, and served in M.U. 70061, MNF, Murmansk Region. On June 29, 1997, he died in military service. The father of the deceased had the right to a loss-of-breadwinner pension but the local Pension Department denied his application because he received a retirement pension as a former military serviceman. On behalf of the father of the deceased, the Mother's Right Foundation applied to court. The interests of the father of the deceased were represented by the Mother's Right Foundation lawyer, Anna Mukaseyeva.
113) On November 2, 6, 11, 18, and 20, the Reutov Garrison Court considered the case of Anton Dolin (b. 1986) who had died in the army. Anton was called up to military service on June 6, 2006, and served in M.U. 3179, Vityaz Special Forces Detachment, Dzerzhinsky Division, Reutov Town. On November 18, he was severely beaten by the contract sergeant, Roman Cherepanov. It's interesting that Cherepanov beat Dolin because the latter ‘had injured the honour of the Special Forces' - he had failed to stand against the patrol of M.U. 6771. Despite his injuries, Anton Dolin continued his service for a day. But then, on November 19, he felt bad and was hospitalized. On December 24, he died of his traumas in the Burdenko hospital. Cherepanov escaped from the unit and was concealing himself for two years in the Altai Region (see p.p. 78, 93). In Autumn 2008, he was delayed by a militia patrol in his home village and charged under three articles of the RF CC: Art. 111, s. 4 (deliberate damage to health resulting in death); Art. 286, s. 3, p. "a", p. "c" (abuse of authority, violence with grave consequences); Art. 238, s. 1 (deserting). The interests of the parents of the deceased were represented by the Mother's Right Foundation lawyer, Zarema Yusupova. The trial was won: Cherepanov was sentenced to 8 years in a colony of strict regime.
114) On November 5 and December 18, the Elektrostal Town Court, Moscow Region, considered the lawsuit filed by the Mother's Right Foundation on behalf of the mother of a dead serviceman, Marina Vladimirovna Kolomytseva. Her son, Evgeny Chistov (b. 1984), was called up to military service on May 14, 2002, and served in M.U. 01860. On August 1, 2003, Evgeny died in a terror act in the hospital of Mozdok. His death was related to his military service. According to the Law "On Veterans", Marina Vladimirovna had the right to measures of social support but the Elektrostal Pension Department refused to give her a certificate confirming her right. The Mother's Right Foundation applied to court. The interests of the mother of the deceased were represented by the Mother's Right Foundation lawyer, Anna Mukaseyeva. The trial was won.
115) On November 5, the Voronezh Region Court considered the lawsuit filed by the Mother's Right Foundation on behalf of the mother of a dead serviceman, Elena Viktorovna Kulkina (see p.p. 75, 76, 99). Her son, Sergei Kulkin (b. 1973), was called up to military service on December 10, 1991, and served in M.U. 2397. On July 3, 1992, he died of acute heart failure; his death was related to military service. The notary of the notary office of the Podgorensky District, Voronezh Region, Klavdia Vasilievna Laktionova, refused to give her a letter of attorney mentioning all the Foundation lawyers. She wanted to be paid for six letters. On July 2, 2009, the Mother's Right Foundation won the trial in favour of the mother of the deceased but the court refused to make a decision on the notary Laktionova's action. The Mother's Right Foundation filed a particular complaint against the court's denial.
116) On November 9, 19 and December 7, the Apsheronsky District Court considered the lawsuit filed by the Mother's Right Foundation on behalf of the father of a dead serviceman, Oleg Anatolievich Dubovtsky. His son, Andrei Dubovitsky (b. 1987), was called up to military service on April 25, 2007, and served in M.U. 12106. On October 3, 2007, he died. According to the decision of February 2, 2009 passed by the Rostov-on-Don Garrison Court, the serviceman of M.U. 11659, A.S. Goloyad, was pleaded guilty under several articles, including Art. 335, s. 3 - bullying with grave consequences (see p.p. 5, 32). The Mother's Right Foundation demanded that the father of the deceased be paid compensation for moral damage caused by his son's death. The interests of the mother of the deceased were represented by the Mother's Right Foundation lawyer, Tatiana Sladkova. The trial was won: the mother of the deceased received 500,000 roubles.
117) On November 11, the Oktyabrsky District Court, Tambov, considered the lawsuit filed by the Mother's Right Foundation on behalf of the mother of a dead serviceman, Nina Vasilievna Romashina. Her son, Andrei Romashin (b. 1977), was called up to military service on December 5, 2000, and served in M.U. 3468 "yu". On February 11, 2001, Andrei died in the army; his death was related to his military service. After her son's death, the mother received the benefits under Art. 21, s. 3, of the FL "On Veterans". In February 2009, Nina Vasilievna received a letter from the Social Development and Demography Committee, the Tambov Administration. The officials demanded that she return her certificate. The Mother's Right Foundation filed a lawsuit against the Social Development and Demography Committee, the Tambov Administration. The interests of the mother of the deceased were represented by the Mother's Right Foundation lawyer, Anna Mukaseyeva. The trial was won.
118) On November 11, the Orlov Region Court considered the lawsuit filed by the Mother's Right Foundation on behalf of the mother of a dead serviceman, Maria Ivanovna Avdeyeva. Her son, Ivan Avdeyev (b. 1988), was called up to military service on June 25, 2007, and served in M.U. 61616. On April 8, 2008, he died of an ailment in the army. His death was related to his military service (see p. 91). In February 2009, the mother of the deceased was summoned to the Social Department of the Livensky District, Orlov Region. The officials took away her certificate explaining that she had no right to it. Since that day, the mother of the deceased has not been enjoying the measures of social support. The Mother's Right Foundation applied to court but on September 17, the Livensky District Court, Orel Region, denied the claim. We filed a cassation appeal against the decision.
119) On November 12, the Moscow City Court considered the cassation appeal against the positive decision of June 24, 2009 passed by the Simonovsky District Court, Moscow, in favour of the mother of a dead serviceman, Raisa Timofeyevna Krokhina (see p. 73). The ‘monetization law' worsened her economic situation. Krokhina applied to the Pension Department for recalculation of her monthly payments but they denied her application. On behalf of the mother of the deceased, the Mother's Right Foundation applied to court and on June 24, 2009 won the case. But the defendant filed a cassation appeal against the decision. The interests of the mother of the deceased were represented by the Mother's Right Foundation lawyer, Zarema Yusupova.
120) On November 12, the Shimanovsky District Court, Amur Region, considered the lawsuit filed by the Mother's Right Foundation on behalf of the parents of a dead serviceman, Nadezhda Filippovna and Viktor Ilyich Zhilin (see p. 128). Their son, Anton Zhilin (b. 1988), served as junior sergeant in M.U. 48422. On September 1, 2008, he died of an ailment in the army. His death was related to his military service. According to Art. 21, s. 3, of the FL "On Veterans", his parents had the right to measures of social support but the Military Commissariat of Shimanovsk Town, Shimanovsky District, Amur Region, refused to give the Zhilins certificates confirming their rights. On behalf of the parents of the deceased, the Mother's Right Foundation applied to court. The trial was won.
121) On November 16 and 17, the Akhtubinsky District Court, Astrakhan Region, considered the lawsuit filed by the Mother's Right Foundation on behalf of the father of a dead serviceman, Viktor Andreyevich Zotkin. His son, Alexander Zotkin (b. 1976), was called up to military service on May 30, 1994, and served in M.U. 3724, Vladikavkaz. On March 22, 1995, Alexander died; his death was related to his military service. The Pension Department of the Akhtubinsky District, Astrakhan Region, denied the father of the deceased a loss-of-breadwinner pension because he received a service pension (he served 22 years in the army). The Mother's Right Foundation applied to court. The interests of the father of the deceased were represented by the Mother's Right Foundation lawyer, Zarema Yusupova. The trial was won.
122) On November 19 and December 28, the Metallurgichesky District Court, Chelyabinsk, filed the lawsuit on behalf of the mother of a dead serviceman, Nurzida Irekovna Atamanova. Her son, Yuri Atamanov (1990), served in M.U. 95501, Moscow Region. On May 12, 2008, he died; his death was related to his military service. The Social Department of the Metallurgichesky District, Chelyabinsk, denied the mother of the deceased the right to measures of social support. On behalf of Atamanova, the Mother's Right Foundation applied to court. The interests of the mother of the deceased were represented by the Mother's Right Foundation lawyer, Zarema Yusupova. The trail was won: the court recognized the mother's right to measures of social support.
123) On November 23, the Chertanovsky District Court, Moscow, considered the lawsuit filed by the Mother's Right Foundation on behalf of the mother of a dead serviceman, Raisa Ivanovna Kasimova. Her son, Mikhail Spirin (b. 1962), was called up to military service on May 5, 1982, and served in M.U. 12394, Kazakhstan. On November 12, 1982, he died of an ailment in the army; his death was related to his military service. Since 1999, the mother of the deceased had been receiving all benefits due to parents of dead servicemen. But on April 1, 2009, the Central Pension Department, No. 8, Moscow and the Moscow Region, stopped paying her monthly payments. The Mother's Right Foundation applied to court.
124) On November 24, the Supreme Court of the Rep. of Bashkortostan (Ufa) considered the cassation appeal filed by the Mother's Right Foundation on behalf of the parents of a dead serviceman, Railya Gilmukhanovna and Alik Dautovich Mratov (see p.p. 37, 68, 96). On behalf of the Mratovs, the Mother's Right Foundation applied to court but on September 30, 2009, the Leninsky District Court, Ufa, denied the parents' claim. The Mother's Right Foundation filed a cassation appeal against the court decision. The interests of the parents of the deceased were represented by the Mother's Right Foundation lawyer, Anna Mukaseyeva. The trial was won. The panel of judges cancelled the decision of September 30, 2009 passed by the Leninsky District Court and issued a new decision: the defendant was obliged to grant MPs to the Mratovs.
125) At the assizes of November 30 (Svobodny Village, Yekaterinburg Region) the 101 Garrison Court considered the application for changing the execution order filed on behalf of the mother of a dead serviceman, Lubov Grigorievna Ishimova. Her son, Nikolai Ishimov, died in M.U. 58612 - he was shot by the warrant office, Bazelev, at the presence of his fellow servicemen. The guilty Bazelev received a real punishment - he was sentenced to 5 years and 8 months of imprisonment; M.U. 58612 was obliged to pay the mother of the deceased 1,000,000 roubles as compensation for moral damage caused by her son's death. But then it was found out that the guilty unit was not a legal entity and could not pay compensation. The Mother's Right Foundation demanded to change the execution order and oblige M.U. 34103 to pay the compensation. The interests of the mother of the deceased were represented by the Mother's Right Foundation lawyer, Tatiana Sladkova. The trial was won.
126) On December 16 and 21, the Preobrazhensky District Court, Moscow, considered the lawsuit filed by the Mother's Right Foundation on behalf of the father of a dead serviceman, Nikolai Grigorievich Azarov. His son, Sergei Azarov (b. 1966), was called up to military service in May 1984, and served in M.U. 51943. On October 13, 1985, Sergei died in military service. Since September 19, 1990, the father of the deceased had been receiving the benefits equal to those of WWT veterans under Article 7 of the USSR Law "Urgent Measures on Improvement of Pension and Social Insurance", No. 313-1, August 1989.
After the adoption of Federal Law 122 (monetization law), some benefits were replaced by monthly payments, and the father of the deceased was granted a monthly payment in the amount of 150 roubles - his status was not taken into consideration. At the same time a monthly payment of a war veteran was 1050 roubles. The father of the deceased applied to the Central Pension Department, No. 10, Moscow and the Moscow Region, for recalculation of his monthly payments from January 1, 2005, i.e. from the moment of violation of his rights. But the officials of the Pension Department denied his application. On behalf of the father of the deceased, the Mother's Right Foundation applied to court. The interests of Azarov were represented by the Mother's Right Foundation lawyer, Zarema Yusupova. The trial was won.
127) On December 17, the North Caucasus Military District Court considered the cassation appeal filed by the Mother's Right Foundation on behalf of the mother of a dead serviceman, Elena Valentinovna Khmylnina, against the decision passed by the Pyatigorsk Garrison Court on August 21. The decision denied the mother of the deceased compensation for moral damage caused by the death of her son, Alexander Khmylnin (see p.p. 3, 67, 103). The trial is in process.
128) On December 18, the Amur Region Court considered the cassation appeal filed by the Military Commissariat of Shimanovsk, Shimanovsky District, Amur Region, against the decision of November 12 passed by the Shimanovsky District Court in favour of Nadezhda Filippovna and Viktor Ilyich Zhilin, the parents of the dead serviceman, Anton Zhilin. According to Art. 21, s. 3, of the law "On Veterans", the parents of the deceased had the right to measures of social support. The Mother's Right Foundation applied to court and won the case, but the defendant filed a cassation appeal.
129) On December 22, the Nizhny Novgorod Region Court considered the cassation appeal filed by the Mother's Right Foundation on behalf of Evgenia Nikolaevna Sokolova, the mother of the dead serviceman, Mikhail Zhuravlev (see p. 98). The mother of the deceased had the right to a loss-of-breadwinner pension but the local Pension Department denied her this pension. On behalf of Sokolova, the Mother's Right Foundation applied to court but on September 29, 2009, the Shakhunsky District Court, Nizhny Novgorod Region, denied her claim. The Mother's Right Foundation filed a cassation appeal against the decision. The interests of the mother of the deceased were represented by the Mother's Right Foundation lawyer, Anna Mukaseyeva. The trial was won: the panel of judges passed a new decision recognizing the mother's right to two pensions - a service pension and a loss-of-breadwinner pension.
130) On December 23, the Chertanovsky District Court, Moscow, considered the lawsuit filed by the Mother's Right Foundation on behalf of the mother of a dead serviceman, Tatiana Mikhailovna Doroshenko. Her son, Konstantin Doroshenko (b. 1971), was called up to military service on June 20, 1991. On December 28, 1991, he died; his death was related to his military service. According to Article 7 of the USSR Law "Urgent Measures on Improvement of Pension and Social Insurance", No. 313-1, August 1989, the mother of the deceased had been receiving the benefits equal to those of WWT veterans since February 1992. After January 1, 2005 when the ‘monetization law' came into force, Doroshenko was granted a monthly payment in the amount of 150 roubles while war veterans were granted monthly payments in the amount of 1050 roubles. The Central Pension Department, No. 8, Moscow and the Moscow Region, refused to recalculate the mother's payments. The Mother's Right Foundation applied to court. The interests of the mother of the deceased were represented by the Mother's Right Foundation lawyer, Zarema Yusupova. The trial is in process.
131) On December 25, the 3 Military District Court considered the cassation appeal filed by the Mother's Right Foundation on behalf of the mother of a dead serviceman, Nabilya Mustafeyevna Galeyeva. Her son, Denis Galeyev, was called up to military service from the Chelyabinsk Region in December 2005; he served in M.U. 54203, Strategic Missile Forces, Sverdlov Region. On March 12, 2007, he died (p.p. 34, 43, 62, 111). At the assizes of October 26, the 101 Garrison Court considered the complaint of the Mother's Right Foundation against the cessation of the trial of Denis Galeyev and denied it. The Mother's Right Foundation filed a cassation appeal against the court's decision. The interests of the mother of the deceased were represented by the Mother's Right Foundation lawyer, Zarema Yusupova.
132) On December 29, the Schelkovo Town Court, Moscow Region, considered the lawsuit filed by the Mother's Right Foundation on behalf of the mother of a dead serviceman, Nina Maximovna Potapova. Her son, senior lieutenant Mikhail Potapov (b.1969), was killed in battle in Chechnya. His body was not identified and he was buried as ‘unknown soldier' under a number. His relatives thought that he was missing. On January 29, 2001, the Vyatsko-Polyansky District Court, Kirov Region, listed Mikhail Potapov as dead from September 28, 1996. In 2002, the DNA analysis helped to identify the remnants of Mikhail Potapov. He was reburied, and his mother received a death certificate describing the cause of his death - ‘a battle trauma'. She applied to the Social Department of the Losino-Petrovsky District for a governor's grant (the so called "gromovskie") which was due to her under the law Social Support to Separate Categories of Citizens of the Moscow Region'. She received a grant which was less than it should have been (equal to those of parents of children who died of ailments in the army). On behalf of the mother of the deceased, the Mother's Right Foundation applied to court. The interests of the mother of the deceased were represented by the Mother's Right Foundation lawyer, Anna Mukaseyeva. The trial was won. The court fully satisfied the Foundation's claim: the defendant was obliged to grant and pay the mother of the deceased the "gromovskie" in full amount.
